Gosh i did not mean they would doubt your IVA failing,i mean't that as a good sign in that they were more bothered about the company who sold the IVA than looking into your debts ect. Sorry if that came across wrong. Typical of me,know what i want to say but it comes out wrong.lol.
Again sorry i did not realise it was the court that had told you they were doing more face to face's,thought it was smeone you knew who went bc.

Do not apologise Dalip, I have been tired all week, and look at what I post and think HELL RL think again that sounds rude.. or stupid, and some days have posted and the next thought what the hell was I doing saying that.
Dalip I am sure the OR will want to know in detail and a fine toothcomb one why the IVA has failed, if I had been out living it up I would be worried and I am sure many fail for that very reason, mine has not, I am more worried by what this damn illness has done, ie my memory is pants... he asks OKAY what the hell did you spend this all on.. me.. DONT remember... aint gonna go down a bucket of roses that me thinks.
I am not dishonest, but I spent the refund before reading here about Tax credit refunds belonging to the OR, only excuse I was not BR at the time... and yes I spent it all.. shame on me, I am only human!!! tut tut...
The only nice thing is I hope the "sweet" young man at the court is as nice in person, as he was lovely on the phone.. now can he just look like Nadal.. the tennis player.. that would be good.. I am kidding here, but if we dont lighten it up and laugh we make other peoples life hell, as my son said.. stop stressing and having a go at me.. a week ago.. I thought RL leave him alone and stop picking on him.. must have done so, got toast as well as tea in bed two days running.

My girls were forever saying "god mum you are always stressed and on about money",then when i had no option but to go bc they said "ok,you spent most of it on us". Now they don't say "mum can i borrow a £5" so at least it does have some plus points

I would not worry about what you spent the money on,if poss explain your illness and how it involves your memory,if they think you are pulling a fast one they can always request back statements for the previous 6 yrs which would show it anyway. A lot depends on the OR on the day. Mine was very nice,very human and very very understanding. I used to have a tin with all my cc statements ect in,every dec when i had a new diary i moved all statements into a chest of draws under the stairs. When we thought the IVA was going through i had a good clear out an threw years of paper work out. Then bc happened. I had to guess at what most of the money had gone on. The only things i could remember where any big purchases. Luckily i had that years paperwork,so before i sent them to the OR i went through them making a note of anything over £200 so that i could explain it. Hi Folks
Okay I got a letter today from some company called NCO, it says their client has asked for some assistance in collecting this outstanding debt. The client (no surprise) is Capital One. They give me 7 days, the letter is dated 17 September! and came in one of those envelopes thats has no post date just EXPRESS UK mail, thats a joke then.
What do I do about this letter, as you know I have failed the IVA, and I am preparing to go BR.
Also can anyone tell me what I have to take to the court on the day, what paperwork, other than money and forms, which I am going to also look at filling in on line when I have done them in draft on paper.
It goes on with the normal, pay in 7 days on phone, if unable to pay phone anyway to avoid the following, normal legal proceedings, count court baliffs, petition to make you BR (which they are not going to do for the sum of £758.66 I am sure), or attachment of earnings.
All advice would me much appreciated.

Okay I am off to bed to look at all this paper work from the court. My friend has advised me to book the appointment, if I cannot find the paperwork by that time which looks to be around 3.5 weeks ahead I am never gonna find it.
Will be back I am sure with more questions that I hope you will help me with, will also do another SOA and get you to comment on it.
Think the letter took the wind out of my sails and was like going back to 2004 when there were piles of them and phone calls. So the quicker I get this over with the better, as my health is suffering now.

You just need your petition and the fee's. Something to read, a drink and a snack as sometimes you can be there for a few hours.

I will have the money for the BR by next week I hope, but until I do I do not want to book the court hearing. Book your court hearing now. If you have to cancel because you do not have the money together then that is not a problem and will not be a problem

Well I took your advice and can tell you that I have booked my day in court ! It is 22 October.
Not sure how I feel right now but at least it is booked. So this week achieved the co op account, and the court date. No replies from IVA people with stuff I asked for, so a phone call to them next week. In the meantime will keep looking for the paperwork.
Lovely lad at the court, friendly and helpful.

Not long to go now and will avoid all phone calls if I can, will keep the letter for the OR as you have advised and any others that fall on the mat.
