Failed IVA and BR questions and SOA

  • Do you have car breakdown cover?. If not being a lady on your own I would suggest it might be useful.

    Is your car insurance fully comp?. If not a change may be wise.

    My car insurance is with Zurich and has been for some years (know all about this get it cheaper malarky but satisfied with the service I was given when I had an accident in 2004, which was not my fault in my sons car, they were outstandingly helpful and got it all done very quickly, son was not happy at all as she hit me up the backside! in his pride and joy car) it is even covered should I run out of petrol, as well as breakdown cover, but I will check that I am right on that. It is fully comprehensive.

    AS you say being a lady on my own I took this insurance policy for the benefits it gave to me, and also includes a courtesy car if mine is in for repair due to an accident. I have several years no claim and I think £29 a month is a good deal, maybe others could indicate if they feel it is not a good deal.

    Dalip on the figures you have upped, should I now take off the emergency, birthdays etc as otherwise once they take off the child allowance I will be in minus surplus and wont they say that is not a good idea?

    I have spoken to someone today in the offices where I work who went BR in June (both him and his wife) at the same court I will have to attend, he told me a clerk dealt with the paperwork, and a couple of things were wrong which he changed and then this person signed against, they then went into see the judge, and like many have said here, he said the judge could not have been nicer, telling them that many people get into this situation and that he the judge was now taking ALL their debt and they could stop worrying, the OR would deal with it all and if they carried on having harrassing phone calls they were to say they were BR and simply give the phone number for thier OR, they came out the paperwork was dealt with, in the meantime they were taken into a room where the OR then called him.

    He went through some things with him, asked for some other paperwork due to his car having lost so much value so quickly, he was told around a week later he could keep the car I think they did an independent valuation on it. He then told me that his credit card is being questioned, ie what he spent the money on, and he has had to supply 3 months statements to the OR. He said this was the only part he got frustrated about, trying to explain what the money was spent on, but none had been spent on large items. He had already spoken with our local CAB who also put him onto the Nat Debtline prior to filing for his and her BR.

    My car is not worth what he paid for his, or what his is even worth with the devaluation, and I do need it to get to work, so that is not my worry, I also have letters from a doctor indicating why I need to use the disabled bay in work, although I have no disabled badge, all of which I will copy and put with a letter as to why I would like my car to be exempt, is that the right way to go about this please?

    However, the credit card issue, I have no idea what I spent on mine I have not had one since 2005, I certainly do not have any statements left from that time either, due to being in the IVA.

    I think this is the area that is worrying me the most, as it is the same with the loans, prior to OH (who did a runner in 2004) moving in here, when my son was 4 I had no loan, no cards and no overdraft. So that would have been in 1998, I know the first loan was offered to me that year, but that one I think I can remember what most of it was spent on. It is the subsequent ones that are bothering me. I know someone said just say you cannot remember but I fear that is going to look pretty dire and not go in my favour. With them being sold on as explained above I have no idea who they were all originally with, but will write to PP and ask them if they can give me copies of everything, hopefully that way I may have more information. If they refuse can the OR obtain more information about them? CAn he get bank statements from my bank who were then Barclays to help sort out when I had them what they appear to be spent on, bearing in mind that account was closed in Feb 2005?

    Sorry for all the questions, but I really feel a bit low today so things are probably getting to me, which on a better day may not.

  • As you have not incurred any debt since 1995 I think you will find that the OR will be fine with everything. Don't panic.

    The reason you were asked about breakdown cover and fully comp was it would probably add some to your SOA and being BR you won't get anymore credit so if you have problems then it is a great way to cover it. If you already have this then that is no problem.

    Oh no TF, my first loan was in 1998 my last was in 2004 I think. I borrowed more when OH ran off with most of the furniture when I was not at home!

    This last one had to be explained to the IVA people as they said I was in the mire so why borrow more. It was also to rob peter to pay paul which most of us know about. It gave me a month or so of the creditors off my back, and also replace the furniture he had scarpered with! hope no one out there is living with him and on here in the same mess, as I found out too many years later that this was not his first time.

    My friend advised me to get help in Jan of 2005 as I was at the end of my tether, I went to the CAB who told me to contact PP, who got me to cancel all DDs, take all money from bank and get wages to new bank, then I went the IVA route, which failed the first time and passed one week later, but it took from the Feb to the August to get as far as creditors meeting, having changed bank accounts and I think the fact I had little to no paperwork meant they had to get all the details, he even ran off with my passport and loan docs only one was in joint names so why he took the others I have no idea, but it caused me a headache back then and looks like it may just do so again.

    So I have not had any loans, credit cards, HP, overdrafts since Feb 2005. IVA was accepted in August 2005. It may not seem like a long time ago, but I cannot even remember who most were with, I know what some of the money was spent on, but not actual dates or who lent it to me. I do know the very first one as I said, it was 1998 only know as know how old 14 year old was back when I got it.

    Most of it went on paying off new OHs debts, not that I knew he had any at first, til the baliffs knocked at my door! a holiday, and some home improvements.

  • Sorry I meant 2005, living in a time warp at the moment :rolleyes:. But I still say don't panic as you haven't incurred any more debt since then and you have given it a good go at sorting it out.

    Thanks I did wonder where 1995 came from! Lets hope the OR sees it the same way as you do.

    I think that is why the actual thought of no credit, no HP, no loans does not worry me, in fact it is not even a case of learning to live with it, it may have been at first as the IVA was taking a large chunk each month, it is more than a relief to have none of it. It simplified my life no end, and we have not starved although it was tougher while off sick, we survived.

    I realise that people going into BR straight off have those worries I had when I took on the IVA, but having lived without the CCs and loans for over 3 years I know I would never fall foul to them again. And would certainly never be stupid enough to take out loans in my name soley if a partner was on the scene! another thing I can do without :T

    The only thing I consider I did right was to refuse to have him on the rent book, I had already lost my home once through stupidity, and as far as I was concerned I had to work hard and wait enough time to get this home, and in the back of my mind was this niggling doubt as to why he kept on about being on the rent agreement with the council!

    Maybe he knew the day would come when I would throw him out, and I dont think he would have gone if on the rent agreement. Best day of my life was when he finally just upped and went while I was in work. I had had him back the year before, due to worrying over the debts, a year on a few black eyes later I screamed halleluyah, even if half of my furniture had gone with him I did not care, and I then I had to face the debts, which I am having to do again now, but now I can see a light at the end of a very long tunnel. And like you all say here I am sure I will be so much happier when this is all over.

    This site has been invaluable not only in help, support and advice but also for my sanity.

    RL - check your totalling on the expenditure column - it's not the same answer I get £20 more.
  • We've had no credit cards etc, for 6 years now and have survived. I have become a great fan of Freecycle and Ebay :D They have been lifesavers.

    You seem an incredibly strong lady and you are doing really well.in taking control of your life and moving on with it.

    My GOD fs you mean I have £20 more or £20 less, now can I ring up Bill Gates and make a claim and complaint that his calculator does not work! told you I was useless with them, and I did it enough times! thank you for that I will do it again.

    I have always had a strong will, I was asked once had I ever contemplated suicide and I just looked blank, the thought has never once crossed my mind, where would that get my kids, or kid still at home! However that does not mean there are not days when I want to scream from the rooftops, but oddly I dont feel sorry for myself, I consider I got into this mess, and I need to get out of it, no one else can, yes people can help, but if I sit on my butt and do nothing then when the baliffs hit the door I will have no one to blame but me.

    So next is go through all paperwork, write to IVA people tomorrow with list of what I need and hope they are kind enough to send it to me, I will even enclose a stamped addressed envelope as I will be using one of their pre paid ones I still have to save the stamp one way!

    Ebay, yes I agree can be a great place for things, NOT however concert tickets!

    Oh and if none of you have seen there is a free M&S £5 voucher to be had simply by asking for a contents insurance quote, Martin has commented in the thread as well about it, and I phoned for mine, I need contents insurance but you only have to ask for a quote not sign up to anything, see front page ,will get the link for you as well. Thats one Christmas pressie sorted IF I get it.

    fs you may like to get that on your site as well, lets spread the word and let as many people get a free fiver, I intend telling my daughter and elder son tomorrow.
