    Are you trying to get all the charges from them, from the first date they charged you any or just a months transaction charges?

    I've just sent off a letter so fingers crossed.

    I used the letter in the bankchargesinfo and just got a letter back from them offering all the bank charges back!!!!!yippeeee!!!!!!!!

    How do i work all this out

    I have several charges dating back to jan 2000 (6 year rule) which i want bank (adding to a total of over £300) plus a few recent charges i will be adding to this list
    How do i work out the 8% charge, is it 8% per month for every month this charge was created?

    Ive checked out the letters on bankchargeshell and bankcharges websites and think i should be able to put those letters together

    Any help would be enormously appreciated :)

    Hi, I am claiming (or rather my partner is this time) for 6 years worth of charges.

    The 8% APR should be worked out like so:

    (AmountOfCharge*0.00022%)*NoOfDays (since the charge was taken).

    FYI: Any charge for unpaid DD , SO or Cheque, or over limit charge etc... is punitive - this does not just apply to banks, but anyone - org or person - the law is quite clear on Punitive Charges vs. Liquidated Damages; so, yes, your friend has exactly the same chance of getting his/her charges back - i.e. 100% in my opinion.

    Also, they have 20 days to provide the requested info (i.e - list of all charges etc... on the account) or they must be reported to the Information Commissioner.

    The case of Durant vs. LloydsTSB proves that this information is "Personal Info" and therefore covered by the Data Protection Act - the most they can charge for admin of this info is £10.

    Don't let them get away with not giving it - they have to and will.

    Abbey gave me grief both times, and so have Barclaycard (they wanted £216 to provide the info!!). They all give in in the end, because they have to comply with the Act.
  • Thanks dchurch24 any advice you can give is very much appreciated. I know that these charges are not enforceable but my friend is still a bit unsure if she could get these charges back.
  • dchurch24 - are you saying that even though my bank has written to me to say they will not provide charges (as they are on my statements) they actually have to?

    HELP

    I was claiming job seekers allowance for 16 weeks and TWICE my J.S.A wasnt paid into my bankl on time so I had direct debits unpaid.
    I got onto the jobcentre to claim my charges back, telling them it was there fault
    I was told to put it in writing , so I HAVE 3 times now, SO NO PAYMENT FROM Jobseekers. (plus many phone calls to Chippenham)
    I have informed the bank this was not my fault, but they were'nt interested charges are now upto £125 !!!
    And still no response from JSA... I have told them I have written to my MP but still no joy.... please email me any help please :xmassign:
