I would go through the statements you have an make an appropriation of the amount you think is due to you. Then write to the bank, referring to your first letter and notify them that you have been charged £XXXX amount. State if this amount is not paid within 7 days then you will start county court proceedings with immediate effect and without further notice. Inform them that costs and interest will be added. Head your letter ' Final Notice Before Legal Proceedings'.
You will find that a reply will be quickly forthcoming.
It is all about taking control and letting the bank see you are in charge and will not be intimidated. Put the boot on the other foot for a change, and treat them as they treat you. Remember they are nothing more than bullying thugs, pickpockets helping them selves to your hard earned cash!

Today he received a letter from Heatons LLP Solicitors asking for an immediate full payment of £545.79 by 4th February or they commence County Court proceedings.
His Credit Limite was £200 and rest of the balance are charges.
What can he do so Capital One can refund the charges back?

Just to let you know i sent a letter to them asking for a breakdown of charges as i dont have any statements anymore. This was over 2 weeks ago and i still haven't had a reply.

this is going to sound really bad , but i actually prob only have the last 3 months !!!!!!!!!have never kept them due to thinking that the banks always win !!!!! i know very very stupid !!! but since finding this site i am becoming very organised !!!!!! many thanks for your advice though :j

I received my response letter from the Nationwide this morning, merely stating if I told them what charges I was on about they would look into it.
As I had used the template letter on Bank Action Group so I thought it was very clear and to the point, I rang them and despite not geting the person who originaly sent the letter, spoke to a young girl who was more than aware of the situation and fobbed me off with the " You have to ask the branch for them " as I pointed out to her my original letter was addressed to the branch and why should I have to do it again ? She became very anoid and cited that she was going over the same thing again and again, well if I dont get a suitable answer Im going too !!
I asked to speak to a supervisor/manager and was told they were all in a meeting, so I asked for her to get someone to call me when they were out. She put me on hold and then came back saying they were looking for my letter. Then came back saying that I had ask for a list of charges, not a list of statements. I was getting a bit hett up now and ponted out she was being a bit picky. but still she went on.
So finaly I said to get a manager to call me, when voila one appeared out of no where, and said she would call the branch for me, and get them to liaise with me. I told her that I wanted a list of charges and not a chat and she agreed.
Dont think this is going to be easy.
If anyone that is/as dealt with the Nationwide and gets a result could let me have there reference number, I would be most greatful. Likewise, if I get a result I will put up the ref number here and on Bank Action.0 -

have been filtering through the last few posts
i wondered if anyone could tell me if me and my partner have a case...
in may last year i had major surgery and lost my job being the one whom deals with finances i didnt get to cancel dd whilst i was in hospital...
we accured dd charges of 150 on the joint account and 150 on my partners sole account..
we were then od and couldnt clear the od straight away so another 30 on each account ect ect
it got worse and worse and now both accounts are 500 od
we have a repayment plan with them for 6 months to pay 100 per month 70 which goes to the loan and 15 beach to current accounts however they are charging us 16 per month in intrest so the account balances are decreasing by 7 each...
they have said at the end of the 6 month payment plan they will put the od into the loan
what i really need to know is if i get the charges i paid back they will prob clear 90% of the od's!!!!!!
but will it afect the agreement i have with them!!!
any help appreciated and if anyone has a template of the letter on adobe acrobat please can you pm it to me..

I have sent the Govan Law Centre letter to the Halifax Bank on 25th january. they have acknowledged receiving the letter by phone but not written to me yet.
As I predict having to take them to Court I have a few questions which I would be grateful if someone could answer.
I live in Scotland, Halifax head office is in England, my local branch is in Scotland. The total amount I am after will be approx. £1,500.
Do I take court action against head office in England from Scotland? (If so how - small claims court in Scotland is for only up to £750 / HMCS Online seems to be only if you both live in England?
OR
Do I take court action against bank manager of local branch?
I am not sure which is the best way to go about this.

vSomething interesting has happened.
I was charged another 2x£30 and a £20 on 23 Jan for last months unpaid dds and over limit charge.
I sent my email via internet banking on Monday demanding a £577 refund.
No reply as yet buttttt today I log on and not only have they credited a loan payment back on that took me over my limit but the £80 charges to. Without telling me. Can they do that? Not that I am ungrateful just that it might harm my claim if they say I accepted a partial refund?

Hairsplitting over 0.15% on the interest rate on this or that product is not competition. A large part of what this site does is to dismember the banks' various offerings and demonstrate that they are fundamentally hardly different. One day a bank comes out with a saver product paying 10% interest, but the catch turns out to be that to get the 10%, you have to have a current account paying next to nothing,so it's not worth switching. How many times have we heard that here? - 'not worth switching'? It almost never is.
The odd thing is that over the last 20 years, technology has transformed almost everything, and made a whole raft of things cheaper, including adding charges to someone's credit card account for paying a day late, yet the charges for doing so seem to get ever higher and the time taken to clear a cheque seems to take longer! How odd! 30 years ago it took 3 days to clear a cheque and now it takes 4! Pay a cheque in to Barclays and they will add a couple more days on for the money 'to reach your account'! Perhaps banks should go back to quill pens and the abacus, because back then, the service was actually better.
Where is the Easyjet of banking, cutting a swathe through it and making the others raise their game? Where is the banking equivalent of what Tesco did to the oil majors, forcing them to sell at the supermarket prices they swore were impossible? Come off it Tim - it's a racket!0 -
andy s = you take legal action against your local branch so you sue them in the scottish courts under scottish law.
us,thecat&debt = yes you can sue them for that. you can get ALL charges back, credit card or bank account. remember the fees may have made you go over your overdraft limit so you then incurred the additional cost of paying their unauthorised rate of interest so really you can claim back more.
student in debt = it wouldnt harm your claim as you have in no way accepted it as part of a settlement. id thank them for realising they were in the wrong and ask them when they will refund you the rest of the money.0
