  • the first thing everyone who wants to deal with this needs to do is familiarise themselves with the law. go to http://www.bankchargeshell.co.uk/ read the website and try to understand it. once youve done that and have a fair idea of whats what then you are ready to actually take on the banks.
    to do this the first thing you need is all your statements from the last six years. simply go into your local branch, see a member of staff and ask for them under the data protection act. you need to know how much theyve charged you so you know how much to claim.

    by the way, there was some talk earlier in the thread about the statute of limitations. it actually expires on debt six years after the debtor last acknowleges the debt.

    banks HAVE to notify you of charges by the way, they can do this in your statement by detailing what yuo will pay next month (which further reduces their arguments on the cost of charges). if your bank have failed to notify you of charges in any form in advance they are breaking the banking code.

    I think the statute of limitations regarding debt is also six years from when either a judgement or a default notice is issued. This why judgements and default notices expire after six months. In the case of a default notice, it appears that some creditors leave it as long as possible before issuing so that the account is in arreas longer and so that the effect of the default notice lasts longer and has a greater impact on the consumers inability to get other credit.

    I'm not allowed to in this forum as I am directly involved.

    There is a solicitor and a barrister in that forum on a regular basis who can answer questions about the DPA and the other legal aspects that I have mentioned.

    Incidently, FYI, my partners case against Abbey is going well - they have just sent a letter offering settlement, which considering the hardship it gave as at the time, we are going to refuse.

    That is also a good site, but not the one I had in mind - the other sites mentioned are on page 31 of this thread, posted kindly by Turning_into_scrooge.

    Both sites are managed by non-profit making volunteers, and it's a shame that I can't post them here, because I am associated with both.

    25 pound, on what account is this please, asfaia they are charging 20 atm.

    they where charging a flat fee of 27.50 an month, then they charged 18 pound a time. Now I belive it to be 20.

    do these differ from account to account, as well from bank to bank

    On the note of penalty charges, will anyone take on the inland revenue ?

    they are stating quite clearly they are going to dish out a "£100 penalty" if your self assessment is not in on time.

  • my HSBC account is just a current account i think. It was transferred automatically from my student account when i graduated. My argument with them has a few points and i will list them

    1. When i was at uni only a small fee was incurred if you went over your OD
    2. Since that time i have never been informed of any penalty charges that would occur. No letters,phone calls no nothing.
    3. Whilst at uni if my card was at its limit say 500 OD and i went to a machine to try and get cash the machine would not let you. Now it does and it surely it does because they know they can take 25 quid per trans. off you next time you wages go into the bank.


    I understand that we have to keep our own finances in order but if i ask for an OD LIMIT of 500 pound then i dont expect to be able to spend over that.

    I am still wondering if i can get the money back? I have the copy of the letter to send to HSBC but i am still not convinced
