Old Debt? Mackenzie Hall

I can also confirm that MH seem to have a cosy relationship with Provident Personal Credit. I have just received a letter from PPC out of the blue, saying "MH have appointed PPC to collect your outstanding Euphony debt". They go on to say that they will be sending out one of their doorstep collectors to discuss repayment options. Until now I have simply ignored MH letters and phone calls regarding this statute barred debt, but if they are going to start sending people around to bash on my door and harass me in person, I think I better start hitting back.
However, the standard letters in this thread seem to apply to credit cards and the like. My disputed debt relates to a disputed telephone bill from Euphony for landline calls in the previous millenium. I am thinking the CCA phrases are perhaps not applicable to a monthly phone contract such as this?
For example, it seems that this sort of debt is not covered in the NDL fact sheet so their standard letter may not be correct:
http://www.nationaldebtline.co.uk/england_wales/factsheet.php?page=25_liability_for_debts_and_the_limitation_act
So do I need to phone NDL, or has anyone seen a standard letter somewhere else that would apply to billing for a telephone service that was paid for and terminated over 6 years ago?
Also, I am not sure who I should now send the letter to, PPC, MH, or Euphony?, or all of them?0 -

I think you should give NDL a phone. I'm no expert but I think an agreement with a phone company will still be classified as a 'simple contract' and the letter in that link would apply. Also, I am not sure who I should now send the letter to, PPC, MH, or Euphony?, or all of them?
Euphony have sold the 'debt' on. As PPC and MH seem to be the same thing, a letter to both of them will cover yourself.
Can you report back and let us know what NDL said?0 -
just a heads up, and dont shoot the messenger. But my missus works for Provident, and they are starting doing the above with Cabot debts too. I.E turning the Cabot debt into a PPC loan. so not only are they collecting unenforcable debts, BUT are making a HUGE profit on them also.0

Also in 'don't shoot the messenger' mode, PPC have been here about an old catalogue debt. I was offered a discount, but told the bloke it was disputed, and he just said OK and walked away.

Just checked my equifax file and noticed a search by MH in July 08 for an address I left in 2001.
Now, I dont and didnt owe anyone anything, all bills paid by DD, I dont do credit cards, OD or bank loans, always paid cash for my cars, no student loans, the search said it was in connection with an outstanding debt - not possible.
I called MH and asked why they had searched my credit file 7 years after I left the address, given that I dont owe anyone anything and even if I had wouldnt the debt be statue barred by now? asnwer, we dont know, the file is closed we will try to get it removed from Equifax for you - I certainly didnt expect a helpful response and Im deeply suspicious of them, am I right to be suspicious?0 -
Wonder if anyone can help me? my partner has recieved a demand for £700 from the department of work and pensions saying she owed this debt from 12yrs ago,now my partner is adament that this debt was paid at the time cos she had a family credit or allowance book(i cant really remember which) at the time and the payments were taken directly from her book each week before she could even cash it,so believing it was all payed off everything was fine up until a couple of months ago when she recieved a letter demanding payment of £700 my partner then foned Departmant for work and pensions tried to explain that it was already paid off and asked the woman to check her files, to which the woman replyed that they could not check back any further than 6 yrs and that my partner would have to provide proof that the debt had been payed (how could she do that when it came straight off her book and didnt have any reciepts and who would keep them this long anyway?) Now shes had a letter from a debt collction agency demanding payment so thinking because she couldnt provide proof that it had been payed she rather foolishly started making payments which have been going on for the last few weeks until i found out and told her not to pay how can a goverment agency who cant check back any further than 6yrs say she owes them money when they cant prove it? Anybody any advice?0

Hi all
I have today received a letter from Mac H with a large NOTICE OF INTENDED ACTION heading ! It is regarding an outstanding amount owed to Aqua Mastercard for £1465.00.
This was being dealt with by 1st Credit and 2 days ago I received a letter from 1st Credit asking me to make an offer or monthly payments to them - then today I recevie the one from Mac H, so I call them. WELL what an A***hole I spoke to, he wanted to know all my personal detail and even asked me which make and model of car I had and then demanded the reg number - which I refused to give him, and his reply was "Well I'll pass that on to a collegue to find out for me".
My question is can I refuse to deal with them ? as only 2 days ago 1st Credit were offering me a repayment plan, yet they have today passed it onto Mac H who are demanding full payment by monday !0 -

Starting point - never speak to a DCA on the phone - they just bully you.
Next thing - have you made a CCA request? If not, get one in now.
And do you have the default letter? If you've have not made a mistake, you've made nothing0 -
Hi,
No haven't done a CCA - to be honest, didn't know what it was, but have just read up on it and will be sending them a letter about it !
I was paying 1st Credit by monthly instalments, but they wrote to say I had defaulted in december 2008 (I changed banks and they were meant to transfer all my direct debits but this is the one they failed to do !) It's taken them this long to contact me, and I genuinely had no idea I wasn't paying them still, so when I called 1st Direct today to reset the direct debit, they said, Sorry too late it's been transferred to Mac H.
Any way I have since called 1st Credit back and said that I am VERY unhappy about my account being transferred to Mac H and that I am happy to pay the money owed by instalments, but NOT deal with Mac H. The first persn I spoke to - a lady called Rose - was lost when I asked why I hadn't received an Assingment notice informing me that my account was being transferred to another company - she then started speaking to me very loudly and said, "I'm not getting into an argument with you Miss B***, goodbye" (I suspect a supervisor may have been listenening and when Rose couldn't answer my questions this was her easiest way out of the call !)
So after calling back and speaking to the very helpful Dan, I asked why I had received a letter from 1st Cedit offering me a payment plan I could afford, and then 2 days later receiving the Mac H gem ! He explained that by law they now have to send out a yearly statement to me - which they had - and whilst they are paying postage sending out the statments they include the 'payment plan' offer and dd mandate to fill in, in the hope that the non paying people actually fill it in with an offer and return it.
Me being one of those 'non-payers' (which I was unaware of until 2 days ago) had rang them to discuss their offer of an affordable payment plan, only to be told I can only now deal with Mac H !! I asked if 1st Credit were withdrawing their kind offer of said payment plan, to which Dan said all he could do was speak to his manager and see if they can get the account back from Mac H and take me up on my offer of monthly payments - So I await Dans call0
