Also just for the record how the flaming hell do these companies get away with buying and selling debts like this, in my view it is a joke!

brilliant thankyou for your replys, a concern i have is that as i previousley stated my partner cannot recall this but is not outright able to say this isnt a debt of hers so therefore if we could find out we would be happy to pay as we dont want it affecting her credit score as within the next few years we are looking to get mortgage togeteher to buy a house, does anyone know how this will affect us?

A credit company can only make adverse comments on a person's credit record if that debt is showing on their credit record.

If the debt has not been paid in the last 6 years, the credit record should not refer to the debt at all. So they cannot damage what is not there.
If you've have not made a mistake, you've made nothing

If this doesn't affect her credit score then you don't need to pay it. Paying debts that are statute barred just perpetuates these idiots' behaviour and ensures that they have the money to make someone else's life a misery.

Last time you spoke to them they threatened and intimidated you into paying, even putting the phone down on you twice! Does this sound like a company that deserves or would appreciate any courtesy?

Ensure all further conversation is done in writing by recorded delivery only. You also have some hard evidence when you submit your complaint to the OFT.

Telephone conversations are a waste of time as it's far too easy for them to pretend they never happened, that 'the person that told you that information was wrong and has now left the company' etc.

  • Hello,

    1st post from me.

Just received a message from Mackenzie Hall (Sheila actually) at my place of WORK!! I think that this is regarding a debt of £160 to the Student Loans Co. I can pay this but don't feel that I should (for a variety of reasons), up till now I've simply ignored all correspondence but attempts to contact me at work are a bit too far!

Now I'm concerned that they will send 'the boys' round to my workplace, is this possible? Now that would be quite embarrassing to say the least. I'm half tempted to call the creditor and pay this off............any advice would be greatly appreciated.

    Thanks,

    Simon.

    Welcome to the forum simon976.

You need to have a read through this thread and follow the advice given to others for dealing with them. It may well be that you don't have to pay this debt if you have not acknowledged it in the last 6 years.

Conduct all communication in writing though, they can lie on the telephone and you'll have no proof of what has been said.
  • Thanks.

The debt is under six years, so this is slightly off topic I know. My main concern is MH sending folk round to my workplace; can/will they do this?

MH do have a 'doorstep collection' crew that masquerades under the name of 'Meritforce'.
However, don't let that worry you - 'Doorstep Collectors' have no rights under Law. They can only visit you by mutual agreement. They have no right of entry to your house, peaceful or otherwise, so unless you invite them in they can not enter. They have, nor should they imply that they have, no powers to 'sieze' any of your goods. You are under no obligation whatsoever to discuss the 'debt' with them, and the only thing that they can do is to ask you if you would like to make a payment towards the 'debt'. They must leave immediately when you ask them to.
They should not visit you at your workplace and they, certainly, must not discuss this 'debt' with any other person, including your employer.

To be honest, though, it is most unlikely that these thugs will visit you - The threat of home/workplace visits is a common tool, used by many dcas, in order to 'frighten' debtors into making payments.
I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.
