    If it's over the 6 years you could have held off on the letter, waited to see if they continue to harass you, then report them to the OFT.

    It is, actually, six years from the date of the last payment that you made towards the debt, or the last date on which you acknowledged the debt in writing, El_C. Or, of course, five years if you live in Scotland.
    The date at which the account was 'defaulted' is irrelevant as it usually takes several months, since a debtor stopped paying, until a creditor/dca registers the debt, with the credit reference agencies, as defaulted.
    Don't worry about your 'telephone conversation' with MH - this will not start the clock ticking again as acknowledgement must be in writing.
    Just send them the letter.

  • I had been receiving letters for the previous resident at my address and although I kept putting them in the post with 'return to sender - not at this address' they still kept coming. I decided to Google the PO Box and found it to be Mackenzie Hall. Thought I'd just give them a quick call to explain the situation; I REALLY WISH I HADN'T!!

    The man on the phone was so rude that I actually asked him not speak to me so rudely; I asked if I should open the letter and he replied "I am not being rude, I already asked you to open the letter and you just asked me again". Ooooh, sorry... I said this was a very unusual call and customer service people don't normally speak to people like that, to which he said, "If you are unhappy with this call then I suggest you terminate it immediately". Very odd. I was in the process of explaining that I was just letting him know this person didn't live here when he hung up!!! Well, they are by far the strangest, rudest, most unhelpful, poorly trained company I've ever had the displeasure of dealing with!

    I'm really glad I don't have any debt with them, but having dealt with collections agencies in the past I can say none of them were a patch on Mackenzie Hall. I see they are in trouble with the OFT, maybe they need another letter of dissatisfaction...!

    As 'Google' gives over 429,000 results for 'Mackenzie Hall' are you referring to the OFT compliance requirements that have been imposed on these leaches?

    my partner today received a letter from mackenzie hall, after ringing them to find out what it was about, ( i took over the call after she had gone through referances ect) all they could tell me was that it was for £164.64, it was a debt they had purchased off of premier man and that it was from her old address but they couldnt give exact details of what it was for or the exact date. My partner has no recolection of this debt but when this was explained to them they got rather stroppy, after the first 2 peolpe put the phone down on us we got the 3rd person wanting me to agree to pay the debt by friday or he would commence further immediate action, i maybe rather stupidly aggreed to this as if i didnt he said he would commence the further action but wouldnt say what this would be How do i stand with referance to when my partner last acknowledged the debt? would this telephone conversation count? To my partners recolection she has not received any correspondance from this debt for years, She moved into the address for approx 6 months back in approx 2001(trying to find out exact dates now), where does she now stand? Have we now acknowledged the debt by the telephone conversation we have just made, i felt like i had to aggree to pay the debt by friday as i felt threatened. if they could provide exact date and order details, we might be able to solve it? could anyone help me out as to where i stand?????

    Calm down!

    NO, you have NOT acknowledged the debt. The only way you can do this is in writing, saying something daft like "Yes, that debt is mine, I owe you money" OR by making a payment (I think to the original people the money was owed to).

    2001 is way past the statute of limitation, she does not have to pay this money back.

    Please read through this thread and this board for further advice, but basically as they know they are chasing a debt outside the 6 year statute, they are breaking the requirements imposed on them by the OFT (see above posts).

    A letter stating that you do not recognise this debt and that you will be reporting them to the OFT if they do not cease harrassing you normally does the trick. These scum work on aggression and intimidation, as you have found out already.

    Please please please report them to the OFT whatever the outcome, it's the only way to teach them a lesson.

    So force them to provide dates (expect them to be fiction) by sending a statute barred letter

    brilliant thankyou for your replys, a concern i have is that as i previousley stated my partner cannot recall this but is not outright able to say this isnt a debt of hers so therefore if we could find out we would be happy to pay as we dont want it affecting her credit score as within the next few years we are looking to get mortgage togeteher to buy a house,does anyone know how this will affect us?
