vodafone upgrade less than halfway through contract?

I'm on my second 18 month contract with Vodafone, which is due to end in July next year. I have a Nokia N95 and the battery life is awful, lasting a day at best. I have purchased a new battery but it is no better. I am wondering whether it is likely that Vodafone will offer me a free upgrade, as I am unwilling to pay to upgrade as the phone is at fault here, not just me wanting a new model!

I doubt it. I was mis sold my contract and although vodaphone agreed with me, the wouldn't look at until 9 months later - even though i told them straight away it was wrong0
