    Claim for what?

"I can't use flash on my phone, so I want to be released from my contract and keep the phone!" ?

"Flash is an integral part of the internet, so I want some compensation." ?

I'd suggest it would be more of a case (at best) of either leaving contract and returning the iPhone as it is not fit for purpose or having a replacement phone that could display flash.
