i need your opininon needed on virgin.net payment problem!

Hi

I have been with virgin.net (one month contract and no equipment supplied) from april 2004 to october 2004.
In october 2004 I've asked virgin.net to send me a MAC number, so that I would be able to change to another broadband service provider. unfortunately virgin.net doesn't want to give me the MAC number (many excuse call this number or will get back to you soon etc etc ). In midd october 2004 I have asked them to stop the service and cancelled my direct debit (credit card direct debit).


here is the interesting bit:


virgin.net didn't stop the service and was able to use the service without paying a peny for it.
recently, they ask me to pay or my service will be terminated soon. I'm not bothered about the service being terminated....cos i can use other companies broadband service... what i'm worried is about my legal rights for example they might report me to credit agency and don't want to be black listed because of this.

  • If you have a response from Virgin acknowledging your request to stop service, I wwould assume you are on safe ground.

    Do you mean you've received a bill for the period AFTER they confirmed the account was closed ?

    Or do you mean you've received a bill for UP TO the date they confirmed the account was closed ?

    I didn't received any bills I just receive a letter from them (after 13 months).

    I cancelled my direct debit and told them to cancell the service over the phone, ths was in october 2004.

    If the bill is for after you cancelled the service and settled any outstanding bills and you have a confirmation that your service was cancelled and your account settled, you could argue the toss.

    If they didnt confirm the account was closed and can prove you've continued to use the service and not pay, then I think they could chase you for non-payment which could result in a CCJ (which I think was your query).

    Either way, its best not to ignore them and try to sort it out. Just my 2p, Im not expert, Im sure someone more aware of consumer law will be along to help you out. You could also contact the Citezens Advice Bureau for some assistance :)
