When you sign the contract it is in the terms and conditions.Ignorance is no excuse.If you had checked the terms and conditions you could have walked out of the gym and gone to another gym.0

I think if you cancel today you will still be able to use the gym until your notice period is up. I would not recommend just cancelling your direct debit as it is in you t&c's you wouldn't really have a leg to stand on if they did decide to enforce their terms.
It's not fair but it is in the small print.0 -
I really dislike Bannatynes too:mad: . Got into the contract cancelled it after 12 months Cancelled it for medical reasons, but the gym said the doctors note had to specifically state that I could not use any part of the gym including sauna, steam room, pool etc etc etc. Try getting a doctors office to write that!
. So got stuck paying for it for three more months.

I can understand what people are saying here but just because something is written into the t & c's doesn't make it right.
If a company decided to put in the t & c's, if you cancel you have to pay us £1million, would that be right, just because you signed it??
Maybe everybody should sit down and read the small print of every piece of paper they sign and go through it with a fine toothcomb first, but the facts are people don't.
I personally have never come across anything with a 3 month cancellation period, and if there contracts have already been investigated by the OFT, it would suggest that other people have had similar problems.
The guy who went in and cancelled his subscription and then his DD, sounds about right to me and is something that I would do myself.0 -
Cheers that that, going to have to bite the bullet on this one then. Will cancel it later on. Looks like I'm still going to be paying it up until October, which financially, doesn't help me at all...! I don't even want to quit, but a change in circomstances (financially) has meant I can't afford it short term (next 3/4 months).

I did read my contract terms (I was on a 6 month membership which I paid a premium for) and following news I was to undergo knee reconstruction surgery I cancelled my membership in writing in October. I cancelled my direct debit only to receive a notification in January saying I owed them a month's membership. I phone the gym and explained and they said I had to resend another letter which I did in January following my surgery, I couldn't go in as I couldn't walk let alone drive.
In April I received a letter from head office saying I owed these funds and the memebership for february immediately. I sent via recorded delivery copies of both letters and on Saturday received a letter saying "without prejudice" they wouldn't receive copies as proof of cancellation and that I had to pay the owing amounts or they would continue my membership. I have already paid them £100 over what I should going by when I cancelled my membership which is one month's notice and now I am being told to pay them more. I AM FURIOUS!!

Has anyone any experience of 'taking over' a membership contract.
My partner and her friend took up a joint membership and have 3 months to go of the 12 month tie in. Owing to redundancy her friend can no longer afford the payments and i would like to take over her membership, how easily is this done, thanks.
NB: My partner is the main account holder an pays via direct debit, £80 odd pound per month.Never Ever Give Up!0 -
To the OP - just cancel the Inform them in writing that you are cancelling and mention that the 3 month notice period is considered to be unreasonable. Technically speaking they have you contractually, but they are unlikely to pursue it and it would be unlikely to ever make it to Court.
3 months is indeed an unreasonable notice period to cancel a subscription for somehting you no longer want or need.0 -
If anyone has been affected by the bannatyne 3 month rule. I would write a letter of complaint to the OFFICE OF FAIR TRADING because they have a judgement pending on the three month rule if their are enough complaints. They will review this stupid rule and hopefully change it.0

3 months seems completely unreasonable to me you can do all manner of more complicated affairs with simply one months notice (leave rented accommodation, cancel Internet etc).
