Sub-letting is generally not allowed in LA housing (certainly not around here anyway, whether it be council or the HAs) so that is very likely why your friend was evicted DC.

Subletting may not be allowed in a council owned property, but this would have no relation to HB/ LHA entitlement, as the two issues are not related.

In her first post the OP says,
" He has been paying me £210 rent, and since he started work that went up to £300 a month. This counts as income for me currently when they work out my benefits".

I'm not sure that Jules meant this but you MUST tell them that he's your partner otherwise you'll be committing benefit fraud, which is a criminal offence.

Quite right, I didn't mean don't tell them. You must tell them asap. It was probably the way I had worded it. It won't affect the IB but will affect other benefits.

Debt at highest May 04 - £65,639.22 - Started DMP with CCCS 1st June 04 & now self managed DMP
Debt now 20th December 2015 £31677.13 Paid Off to date £33962.09 - just not going quickly enough!

Debt free date July 2024! I don't think so, it'll be going quicker than that!!!

Can you earn £300 a month and get benefits, or is this just housing benefit?

DMG was responding (I think!) to DCs post which asked whether the OP could be evicted for sub-letting when she is in receipt of HB.

The answer is no and DCs friend was more than likely evicted for sub-letting a council house rather than because she was on benefits. She could have been prosecuted for committing fraud if she didn't tell HB she was sub-letting, but not evicted iyswim. Two different 'crimes' and two different punishments, so they are not related in that respect.

There is no problem with them claiming HB and subletting, so long as they declare it to the HB department and the OP has said they've done this and the income has been taken into account.

I may be wrong, but I think that's where the confusion is creeping in?

Yep, you're right - I though it was pretty clear as I even quoted what I was replying to! ;) x

    Woah, woah people.
At the time there were three of us sharing the house I was claiming no benefits, we were all students. And at that time, yes the other two's rent covered my rent. Nothing wrong with that.
Now when there were only two of us, and we weren't together, his rent did not cover my rent, and it is perfectly legal to sublet, it counts as income and therefore is too much for me to get IS but doesn't stop me getting HB.
It's a private house I'm renting, not a council house.
    Saving for a house deposit.

Trying to sort clutter and sell as much as possible to make room and money!

No worries - we realise that! It was just that the thread went off at a tangent and got a bit muddled on the way.
