GAAAAAH! Rude sellers grrrr

I buy and sell bits and pieces on Fleabay (well only buy now after the announcements of the new charges...) and when my buyers have a problem I offer a refund although I don't list that, only for faulty items though not "it doesn't fit".
So I saw an outfit that would be great for SILs upcoming wedding which was listed as : WORN ONCE FOR A FOR A WEDDING LAST SATURDAY, FROM A SMOKE/PET FREE HOME.
I won it a £7 + £4.95 postage... well heck I've been known to put high postage on and refund the difference or if things are very carefully packaged then I charge what it costs me to package them!
Still it's a £70 (alledgedly) outfit and £12ish isn't a lot for an outfit...

So it arrived this morning (VERY fast - which is good!) but the dress has a mark on it like someone has spilt something on it as does the jacket! :mad: So both parts have been stained on the front where you can't miss it! Now it might be possible to get the stains out at the DryCleaners but no idea if it IS possible...

Wrote the seller saying basically "hi sorry but it would seem there are stains on this outfit etc etc" not asking for a refund (full or partial) but basically leaving it in her court...

The reply was... well... very very rude ot say the least! Basically saying if I'd wanted a brand new one I should have bought one! I don't expect labels in the thing, I am well aware it's been worn once, but I think 2 very visible stains certainly isn't something I'd forget to mention!

So... being fairly reasonable person that I am... I have said "ok tell you what, you think drycleaning will be £10 how about we split the drycleaning fee and you refund me £5, alternatively I can return the item to you at your cost and you can refund me in full".
That's not unreasonable is it? :confused:

    thing is, you wont ever get the seller to agree to sending it back at their cost. even if you go through paypal

    Assuming that this is a private sale, it's caveat emptor. So no requirement to accept a return and certainly not to pay for it to be returned. Still, worth a try :) .

    Anyway, this is what the feedback system is for. For the price it sounds reasonable to me to expect you to clean it, but you really should have been told about the stains up front so you could decide that for yourself.

    Used clothing may be listed on eBay, so long as the clothing has been thoroughly cleaned according to the manufacturer's instructions and is stain free

    Item is dryclean only so no can't just clean it myself - and certainly wouldn't do so until everything is settled lest I get accused of damaging it...

    I have to say I'd NEVER send something out dirty with stains on it... More to the point I make a point of listing (probably to my downfall) every minor blemish etc when I list things (and they're clean!) so 2 rather noticable stains do upset me a bit! For all I know they might not come out.

    Well she has till this evening to contact me back before I put in a paypal dispute and neg her...
    Ideally I would like the postage refunded if I return it as it IS definitely not as described, but I'd settle for the majority of my money back and then I'll warn others against her...

    Don't neg until a dispute etc is finished, you don't want to give away your (small) bit of leverage!

    The problem with a "worn once" item is that it makes the buyer think it is likely to be in near new condition.However when "worn once" a number of things could have happened eg/ spilt wine down the item or even fallen over in a big puddle of mud!! lol

    Therefore be wary when expecting good condition just because it has only been worn once.

    The others are correct even if you win dispute you will have to send it back at your expense so best to try and sort first

    i once bought a Hugo Boss suit on EBay (and it wasn't cheap either!). It was advertised as a year old and as new condition.

    The suit i got had huge 80's shoulder pads and yellow/brown urine stains around the inside of the trousers crotch area.

    I have never since bought 2nd hand clothes from EBay!

    Well I'm resigned to returning the item to the seller (I'll just have to go to the shops and buy something instead - shame as the dress fits) purely on principle now... Manners really doesn't cost anything so she's going to get a neg, the item will be returned on tuesday (signed for) and as I have already opened a dispute on Paypal I guess the money has been "frozen" in her account?
    Unfortunately Ebay won't let you open a dispute until after some silly amount of time but hohum!
    I agree that expecting NEW when it says worn once is a bit unrealistic, but I definitely don't expect big blemishes where she's obviously spilt something on it (not taking into account it should be clean before being sold!)

    But is it not worth keeping the dress for the £7-£8 net refund you'll receive? You can still neg the seller.
