To be honest - not sure that anywhere will be open today. Will probably have to wait until Tuesday.

As others have said, you've taken the first brave step posting on here and facing up to it, which is one of the hardest things to do, but now that you have, things won't seem so bad from now on.

CAB, CCCS and National Debtline all offer free advice and will help and re-assure you - it was a massive relief for me when I contacted them and they are all non-judgemental, they will advise you as to what to do.

I do strongly suggest that you see if you can get hold of all your debts and with the help of the above charities, they can work out the best plan of action for you, and help you write to your creditors. It may still be worth offering them token payments for a while, just to give you a bit of breathing space until you can some sort of regular action plan in place.

Good luck and do keep posting.

As soon as my Barclaycard account was handed to Mercers I hit them (Mercers) with a CCA request. No CCA has ever been produced and the account was handed straight back to barclaycard and they are now accepting my (very) reduced payments.

    Might be worth doing.

Definitely contact one of the debt charities -CCCS, CAB, Payplan. They will give you invaluable help and advice. I have been with the CCCS for over 4 years and they have been brilliant.

Don't let these creditors bully you, don't take their calls and only correspond by post, it is only money and not worth getting upset about - easy for me to say now, I know how you are feeling, but its true.
You have come to the right place, keep posting the guys and gals here can offer invaluable help and advice.

Good luck and please try not to worry, it will work out you'll see.

Thanks Jules for your advice. Did anybody from Mercers ever call round to your house?

What is a CCA request and how would I go about doing one?

    Thanks

Mercers did call to my house - sorry probably not what you wanted to hear.
If someone does call, just tell them to bog off. They have no legal rights and cannot take any of your stuff. if they refuse to leave, call the police. I left the guy standing on my doorstep for 20 mins in the pouring rain whilst I had my dinner - he soon got the message!

There is a letter somewhere on here (not very good with links) that you can send requesting your CCA (Consumer Credit Agreement - I think) This will put the debt into dispute until they can locate a true signed Agreement. Many creditors don't have them or not genuine ones so the debt becomes unenforceable so chances are they may accept reduced payments or pass the debt back to Barclaycard. Hopefully the experts on this will be along soon.

Please don't worry - if you don't have it then they can't have it.

I am going to tell my parents but they are away till tomorrow night and being alone in the house with thoughts that someone is going to come back to my door is a scary prospect.

My parents know about all my credit cards bar one so hopefully it won't be too much of a surprise for them.

It is a scary prospect but if it's any consolation, I'm female and on my own and I told them to get lost in no uncertain terms. Please don't fret - it's probably costing them a fortune to send someone out anyway so let them waste their money! I didn't have a lot of confidence to deal with these guys until I found this forum and spoke to the debt charities and realised what my rights were and what their rights were and since then, I've gained a lot of confidence in dealing with them.

First of all, decide what you actually want to achieve.

    1. Do you think you can manage to get on top of the debts given some time and breathing space? If so, get in touch with CCCS and follow their advice. You should then have put a stop to any 'personal visits' and be able to reduce the debts on a sensible timescale which you can afford.

    2. Do you think the debts are just going to keep spiralling out of control? If so, you will need, in one way or another, to have some or all of the debt cancelled. Whether, this is a voluntary arrangement with your creditors en bloc, an IVA or bankruptcy (in order of severity) there is a route suitable for your circumstances.

In any case get CCCS to guide you. They will issue you with a reference number and template letters, if appropriate, that will enable you to get things under control.

I do susppect, however, that things are probably not as bad as you think and that the personal visit has done what it is intended to do - scare you unecessarily. At the end of the day, as someone has already said, it is only money and there is definitely a solution.

  • Hi Amy, are there any over limit or late payment charges on this credit card you could claim back, thus reducing your debt to them. Hang on a minute and i will get you the letter requesting the cca to send to them. BRB xxxxxx
