Help - Lost phone insurance wont pay out

In April 2008 I purchased a phone via Mobile.co.uk it came with free insurance (1 month I think). Just after I got the phone I received a call re the insurance when I advised I would not be taking it out they said fine. As i never recieved any documents I presumed the policy had been cancelled and that was that.

I then noticed that my bank statement showed a payment of £7.99 had been taken by Car Phone Warehouse. I was not sure what it was for but when I eventually got round to sorting it out it was the insurance that I thought had been cancelled.

Since I did not have any policy details I had to contact mobile.co.uk for the detaills of the insurer. When I called them they claimed that they had never phone me and the policy had not been cancelled. I cancelled it there and then and they said i would get confirmation with in few days. - I have never received anything.

on 208/08/08 I stupidly left my phone on the cashdesk at morrisons supermarket. I phoned the store within 1/2 an hour but it was long gone.

In desparation I started checking my other insurance policies to check if was covered when I noticed that cpw had taken another payment out in July 2008. I phoned them to ask why and they said because I had cancelled the polciy the same day as they payment was taken it could not be stopped. so I asked what date I was covered until and to my delight and relief I am covered until 29/08/08/. I explained what had happen and they said could make a claim providing I had the relevant crime number( which I had)

I have now been told that my claim has been rejected because my 7.99 a month policy does not cover me for loss - they suggest I read my policy wording!!!!

I have checked the cpw website and they have many different policies/tariffs and 7.99 is not the cheapest. Do you think I could argue that because they had not supplied me with the relevant information I did not know I was not covered for loss - and if I had received the details I would have arrange a policy that did cover me.

Any advise would be appreciated
