Buyer requesting money back

I've just sold a dress on eBay. The buyer has now emailed me, telling me the measurements are wrong (I explicitly stated each and every measurement on the dress, so I know its not), and that there are marks on the folds of the scarf, and 'crusty marks' on the sleeve.

I know without a doubt, that this item is as good as new. Its been packed away since I bought it, and never worn, only opened to take (lots of) pics. I have lots of pics of the sleeve and the scarf where she says there are marks, so I have evidence that the item is brand new.

I don't want to give her a refund, as this is one of those items that people generally wear once, and then sell.

Can she make a claim on Paypal? I had some money in my Paypal account and have moved the money to my account - if Paypal find in her favour which I would find incredible, can they retrieve the money from my account?

    Is her feedback left for others full of moans and groans, is she a picky so & so who if she does not like something has a need to carry on about it? I only ask because I feel as a seller too you seem to have advertised everything correctly. Trouble is she can leave you a neg now if you tell her you feel you dont want to refund her & you cannot her so holds all the cards. Should she open up a paypal dispute they will review everything and all descriptions advertised so unless she is telling fibs on the measurements herself differing to yours I dont see how they can vote in her favour?

    No, she just leaves the same feedback for everyone. The item was expensive, and I'm guessing she just didn't like it as much in person, or it didn't suit her.

    I know the item through and through because I took lots of close up pics of the embroidery/work on the sleeves, the hem, the scarf etc, so I know there are no marks on the dress. I also have the pics.

    I'm not too bothered about the neg to be honest :S more worried that Paypal can just take the money from my account, if she lies about the item.

    I've asked her for pictures asap of the marks, hopefully I will have corresponding pics from when I took pics to show that there were no marks when I sold it..

    I think from the sound of it from what you would put to paypal (should it get to that stage) to dispute the case with all your honest listings of the item and that you can back it up with the photos & your own feedback gained so far as a trusted seller it may be ok. I should not worry about it getting to all of that yet. Just tell her how it is (if your not bothered about a neg) and that your sorry she feels the need to find its not as she hoped it was but stick to your guns and say you have sold it exactly as described so wont be refunding her and hopes she will be able to sell it on successfully herself.

  • Sounds like a seller that I had recently. I told them to return the item and that I would check it on its return and never heard from them again. Have heard that some buyers create problems so that people will refund them without wanting the goods back. Can be a gamble though.

    Well, I emailed her requesting that she send pics of the marks, and that she document differences in measurements. She hasn't emailed back so I'm assuming thats the end of that!

    Ok, now she has emailed me with pictures of the marks. Unfortunately for me :( I've realised that I deleted all the pics I took! I put together a collage of the pics for the listing, and then deleted the originals - sooo gutted! Will never do that again! The pic on the listing does not zoom well enough, however I'm certain that the mark on the sleeve was not there when I sent it to her, I would have noticed it, when I took pics, packed it up etc..

    So now its my word against hers if this comes up as a dispute. Will eBay/Paypal rule in her favour?

    If you took the pictures on your digital camera you may be able
    to recover them as long as you haven't formatted your memory card.

    You can use Recuva a free piece of software to get the images back
    see here http://www.recuva.com/ , it has worked brilliantly for me.

    Check your recycle bin, they may still be in there with any luck.
