ypgrading contract problem

Hi

Wonder if anyone can give advice.

DH was on a contract , had about a month left and went into the store to see about getting new phone .

The new pone he got has internet , and so got the relevant package on a 18 m contract with unlimited internet , which was more expensive than the last one as it did not have internet on it.

On his invoice thing that he signed when he got the phone it stated he had 18m and 27 days contract for new phone.

Alls well....

He has now received his bill and seems he was still on the old contract, according to the woman fron C.S. This was never mentioned at point of sale and with it being a 18m and 27 d contract we assumed the new contract started when buying the phone and they then added the remainder of old contract onto it,
Also the guy that sold the phone said when we originally got the phone that the old contract (days left to run) just gets added to the end of the new one.

We have now had a massive bill in as DH using internet , which he assumed he could do free.

We are going to see guy who sold us it , but where do we satnd.

    There are a few reasons why they could be billing you. (See also this thread on MSE for an issue where the phone was used as a modem or this thread where there were two SIM cards and two active accounts).

    The best thing to do is understand why the phone company thinks you should be billed for it (so you probably need to ask) so that people can argue against the specific issue - it might be a clerical error and when a human looks at they simply credit your account (and therefore not really a problem). If it is still a problem, I'd hope that the "invoice thing that he signed" clearly states in your favour, so check your copy of that.

    If this doesn't solve the problem, you might need to elaborate on a few things. Why are you being billed? Which company did you buy from? Which network are you on? (ie which contract terms are you being held to?) Was this the same vendor as the first contract? How was the upgrade being handled? (ie was there two SIM cards?)

    Thanks for replying,

    There was only one sim, this was our original sim , so only one account.

    The person in c.s is saying our contract did not start until the 27 days had ended, thus the paper contract is stating differently.

    We are billed our old contract rate this month 20th of month and C.S say the new contract starts after this, same account , although the paper one is stating differently. The paper one does not give a start date but just says contract is at least 18m and 27 days long .


    The company was cpw and o2 provider , this is exactly what we were using with our prior contract , and we did not get a new sim, still using the old one with same telephone number.

    Is that person in c.s. in O2 or in CPW?

    Physical proof (like an official written communication) stating something they are now saying is incorrect is a strong stand point for enforcing your point. If CPW have misrepresented what they were going to do, I would feel confident of claiming against them and O2 (as CPW's trading partner).

    Make sure to keep a copy of the paperwork in case you need it later, even if CPW ask to see it. (Call me paranoid ;) )
