T mobile and faulty phone HELP PLEASE

My son has a phone contract with T mobile and while on holiday he had his phone stolen ,he had to pay for a replacement because he had insurance which he took out at the time of the contract,now the new phone which came from Fonesafe is faulty and is only one month old,when we rang T mobile the lady said they are having lots of problems with this phone its a sonyericssion K850i,she said he would have to deal with Fonesafe which can only offer a repair that would take 3/4 weeks and there is no replacement to use ,if the fault happened within 14 days then he would get a replacement.
His contract is with T mobile and the phone is only a month old ,what should he do?should he stop his direct debit and write to head office?please advise.:confused:

    The contract for the sim card is from T-Mobile, but the handset is from Fonesafe. Unfortunately you are at the mercy of their repairs procedure (so long as it is reasonable).

    By any chance is the problem that the touchscreen keys on the handset go haywire and do their own thing and the handset crashes? Try a software update from the sony ericsson website first, might save yourself a long wait for a repair.
