Capital One - Needing Help

Back in feb 07 I filed a court case with capital one credit cards and there still ignoring my letters

Couple of weeks back ( about 7 ) i sent them another letter including a copy of the court case form that i printed off Money claims online but still no reply.

The interest is adding up now and am not sure what to do to get a reply from them?

Any ideas?

    I'm not entirely clear what the situation here is. Have you had judgement by default?

    hi

    if you made a mcol claim did they acknowledge the claim or defend it?

    if not you can get judgement by default

    you should be able to do this online.

    claimed/settled - Natwest £2,535/£2,535, HSBC visa £80/£80, MBNA £1,258/£1,258, capital one £282/£282, tesco visa £515/£515, HSBC visa £140/£140. HSBC £1,450 MCOL Stayed for OFT case. Chelsea Mortgage charges & cashback £5000/£672. complaints with banks pending OFT Halifax £30, A&L £35. TOTALS £11,325/£5482

    They defended the case on MCOL and it was last year.

    Then they tryed to send me part payment but i sent it back with a letter saying i want full payment and heard nothing from them since. they then told the court that the case is settled cause they made payment.

    I dont know what to do about this now?

    Amount am claiming is £699.57
    Court Fee's: £80.00

    Date of court: 14/02/07

    I know i can claim another 0.15% from that date until settlement. So i have worked out to this day am due another

    556 days over court date x £1.04 = £578.24

    So final total now i should be claiming is £1357.83

    Is this correct do you think?

    letter is now being sent claiming i want the above amount now due to them taking so long and also if they dont reply within 14 days i will file another court case againest them

    They told the court it was settled ? Did they tell you they were doing that and did you speak/write to the court to say errr no it bloody isnt ? Contact the court now and ask them the status of your original claim.

    will be calling court 2mo.

    But in the mean time does anyone think its worth taking them to court again as is my firgures correct above about the interest?

    According to your previous thread Capital One paid the DCA part of your claim to clear your debt and sent you the remainder so I don't see how you can go back to court with this.

    Cap one sold the full debt to the DCA so i dont see how they can pay a 3rd party company when am making a claim againest cap one to make payment in full.

    Also they tryed to send the remaining amount to myself and i sent the cheque back saying i wanted full payment

    Update

    phoned the court and it is awaiting be up infront of the judges etc in next couple of weeks. Here is the problem. As am in scotland i used a mates address for the paperwork side of things as means i was able to go thru MCOL but now am unable to get hold of him in anyway and when i do i get all the promises etc then dont here from him again for a few months.

    Am i able to close this court case and do it again but go thru the scottish courts instead?
