Faulty Goods on delivery

Hello not sure if this is the right place for my post but I hope someone can help.
I recently ordered table and 6 chairs (may) 4 chairs without arms 2 with and the table is marble..supposed to take 8-10 weeks but just arrived Fri 15thaug. Only hubby at home so he didnt think to check all the chairs, thought I changed my mind, and ordered 6 the same (without arms).
Delivery people are supposed to check items for damage but did'nt and were well gone by the time hubby did. He noticed several chips from around the edge of the table.
I contacted company and they say because we signed delivery note for accetance of goods we cant get compensation from delivery company and is (to me kind of saying "so what do you want us to do")?
Im not sure as customer what my rights are and would like so advice (also been told by the company that their order shows 6 chairs the same but my order clearly states diffrent ...
dont really want to get into an angry rant but the chairs and table were not cheap.
I have asked for compensation but not sure what percentage to ask for
....thanks.
(is my punctuation better now?):p

by the way you did not give me any advice0 -
When you sign for something, you should check what you are signing for.
When you sign for goods, you're signing to say you've received them in good condition, so you either need to make the delivery person wait whilst you check them (not always practical), OR write "unchecked" on the form where you sign.
If you did neither of these, then it's now difficult to prove that they were damaged in transit rather than damaged by you.
You could try getting the company you bought it from to replace/repair it, but as you signed to say it was in good condition when you received it, then they don't have to do this, and you're not actually entitled to compensation.
In future, ALWAYS write "unchecked" when signing for anything if you haven't checked it!!Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')
No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)0 -
thanks for the advice!!! Sorry for the advice needed, but really did I need Mr Spell Check? perhaps it's time for you to go back to school or do you just spend your time correcting everybody?

Whilst dreamypuma was somewhat sarcastic he/she does have a point.
I read your original post and was going to try give some help, but the lack of punctuation made it so difficult to read I just gave up and moved on..contacted company they say because we signed delivery not for accetance of goods we cant get compensation from delivery company and is (to me kind of saying "so what do you want us to do")
Whatever does that mean ?
I believe you have received items that were different to your order, and some were damaged, but why do you want compensation instead of what you ordered ?
Go back to the company you ordered the goods from and ask for them to collect these items and either refund your money or supply the correct items undamaged.
Your local Citizens advice will help in negotiating with the company if needed."The whole problem with the world is that fools and fanatics are always so certain of themselves, but wiser people so full of doubts."

thanks for that but I checked yesterday and was advised that even if you sign the delivery note you still have 3 days to check goods over and there is also the Sale of goods act S14(2)Not of Mercatable Quality,so Im hoping to go down that route and get a new table top...
But surely you'd still have to sign as "unchecked" to get the 3 days to check the items? Otherwise it's hard to prove where the damage occured.
You've signed to say they're in good condition when you received them, and NOW you're saying they're not, which means that you're on shakey grounds trying to apply the Sale Of Goods act as you've already contradicted yourself.
Who did you order them from?Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')

I doubt you were advised of the requirement of "mercatable" quality under SOGA. Its not even a requirement of "merchantable" quality anymore but of "satisfactory" quality.
Check the terms. They probably say that you have 3 days to notify defects in delivery. However, if you have signed it to say that there were no defects, then you have not exactly done yourself any favours.
I don't think it is 100% fatal to your claim. Did you pay by credit card?0 -

No I did not pay by credit card, I have checked with CAB and they say when you sign dispatch note that you are only signing as receipt of goods, and that if it is a delivery problem then it is up to the merchant to sort it out..
If I was the company involved, I would be saying that the delivery organisation was an agent and that you were signing to say that you had inspected the goods and that you agreed with their condition.
What did the sheet which was signed actually say?0 -

I have looked at the terms and conditions of the company and it says if there is a fault they must repair or replace with no extra cost to us..if you want to look its a company called vertigo interiors...perhaps Im reading it wrong ?
but I think it is there responsability0
