You don't like them. They don't like you...but you still want to force them to sell to you and on your terms too?
You're sending out mixed messages, it sounds like you're desperate to buy from them, but you're also trying to negotiate hard on price. That can't work.
I also think you made a mistake in trying to go over the heads of their salespeople. If I was the Chairman of a development company I'd be a bit miffed at being second guessed by random customers regarding the movement of the market! (Whether you're right or wrong).
Anyway, until you have exchanged contracts they aren't obliged to sell to you.0 -

Sit on you hands and in 18 months that house will be on sale for under £150kBankruptcy isn't the worst that can happen to you. The worst that can happen is your forced to live the rest of your life in abject poverty trying to repay the debts.0 -
It could be the classic standoff situation, whoever speaks first loses.
If you really want the property you'll have to contact them and see if they'll still sell it to you but it will be on their terms or nothing.
Else just do nothing, they might come back to you in a few days with an offer - or quite likely they won't.
If you find a property you really want it's not really worth farting around over £3K ... what difference would that make over the term of the mortgage as opposed to losing out and not getting the property you want.
Perhaps they'll still take your money if you can pay the price you agreed and complete by the deadline.0 -
So we sent an email today saying that due to changes in our circumstances we are having a trouble with finding money for stamp duty and legal fees and asked if they are willing to pay it.
From the builders point of view this could be the bit that made them 'boot you off'? You're saying you may struggle to pay for it and if they have others waiting, in a better position, you can't blame them. However there is no excuse for them being rude.A retired senior partner, in own agency, with 40 years experience in property sales & new build. I would say that the developer is having a bad time at the moment and is a bit of a cross patch, so when he saw your email, he said 'sod em' and told them to reply giving back your cheque.

They agreed their lowest price, you said you can't afford it without them chipping in 3k more. They agreed to refund your reservation fee. End of story.

We looked at St Mary's Island when it was very first being built and it looked lovely. That was before the school and doctors were there. Then we saw the plan for how many houses and flats were going to be built on that tiny patch of land and realised how crammed it was going to be. We have a friend that lives there and the few times we've visited, parking anywhere is a nightmare! The houses and streets are packed so tightly together but you pay so much for it - to live in what is effectively the centre of Chatham.
On the link it shows availability and that the last plot is sold, is that you or have the developer given you back your reservation fee because they found another buyer? I have looked and cannot find any sale that actually completed in April for that kind of price (I presume we are talking in the area of Tappan Drive) so how do you know one did? I have been watching St Mary's Island on my property bee since March and the prices there are dropping weekly and still nothing is selling. Don't be misguided that some areas hold their value because of a prestige attached - they don't. The developer may well have done you a favour.0 -

You agreed a deal then you reneged. Then you ask if the builder can withdraw. What planet are you on?
I personally can't stand people who agree a deal and then get greedy and don't want to stand by their agreed deal. The time to negotiate the price is before agreeing the deal.
It appears you have no valid reason to break your agreement with the builder apart from your own greed. You have no sympathy from me and I think the builder is more honourable than yourself by offering the return of your deposit. exactly, lucky escape - others have not been so fortunate and lost a great deal of money, be thankful you can walk away, wait until the market improves buy something much better...0
