3 upgrade problems

I am very disturbed at the moment. What happened was my 18 month contract is due for renewal mid September. End of June my phone gets damaged so I ask for an early upgrade, which 3 agree to and they send me a 'brand new phone'. Turns out that that was a complete lie. The phone was a refurbished and is now misbehaving already!:mad:. I am currently on 500 min for £15 pm. I told them that come September I wanted a new tariff (1100 mix and match for £20). Customer services agreed that had been noted on my account and that from 18 September I would be on 1100 M and M. I called them today to report about problems with my new phone and they said I am over the 14 days cooling period so nothing they could do:mad:. I say OK well can I agree on 1000 voice and 100 texts for my new tariff from Sept. They say my account notes that I am to carry on with my current plan for the next 18 MONTHS!!!:mad::mad: They said they have NO record of that and nothing they can do. I asked to speak to a manager and I was put on hold and then they hung up on me I think.
PLEASE please someone let me know where I stand with this as I did not get it all in writing (was I supposed to?) and if there is anyway I can get the price plan I thought I had registered interest in. I feel so conned and foolish...

Hardware issues - As they provided goods, I guess the goods will need to be, at minimum, fit for purpose (ie if it doesn't work, it should get fixed or replaced at the vendors choice). That's the good news. Bad news is that unless you can prove that they were described to you as "Brand new", it's quite hard to argue the goods were not as described (which I believe would entitle you to a refund).
Contract issues - If you're on a £15 tariff, you can change up to a £20 tariff whenever you want, no? Is that not what you want anyway? Or is the MnM 1100 normally more than £20 and you'd lose your renewal discount?
And I have to say that posts like this REALLY make me want to record all phone calls I have that deal with contracts (I have no problem with them recording conversations - it's as much for your protection as theirs).
You might be able to make some form of data protection request and ask for all details they have relating to you including any and all conversations that they have recorded. At this point I always find myself asking if they have no conversations recorded, how can show that a new 18 month contract has been agreed to.... perhaps I ought to start a thread.....*I reserve the right to have an opinion, the right to change this opinion and the right to be wrong.*Hope that helps.
