Life after bankruptcy

I go bankrupt 9.15 am on the 21st August
I was really looking forwrd to it till I checked what my income and expenditure was going to be after Bankruptcy :eek: :eek: :eek:.

Income: £60.50 per week IncomeSupport

out of this I have to pay £5.00 per week for Rent Arrears as I am subject to a suspended posession order and this still has to be paid OR should allow this

£5.00 per week to local court as I got caught having no TV Licence

£10.00 per week to the CSA thats £5.00 per week flat rate as Im unemployed and £5.00 of the £575 arrears.

That leaves £40.50p per week to cover Elec Gas Food WRates TV Lic and any sundry expenses...just about doable as long as Im very very careful.

What worries me is that after being declared Bankrupt I will still have around £2000 worth of debt as the rent arrears court fine csa debt and wtc overpayment is supposedly not covered by bankruptcy??

I will be chipping away at this amount weekly until there paid from my Income Support but could the Judge/OR look at this and think no Bankruptcy???

There is some light at the end of the tunnel the CSA based there deductions on my WTC and wages, since last week WTC says I was not entitlted to WTC from Jan 08 so in theory CSA should review my CSA payments and clear the said debt as I will say if I was not entitled to WTC then they had no right to include them in there calculations...might work who knows thats another battle in the offing.
Maybe Im doing some last minute panicking here, Im so so close but feel that something is going to pop up and say NO to bankruptcy..I think a nice long bath and a cream cake is in the offing...

    Anne when i went bc i did my forms on my own by hand,never got them checked or anything. Back then i never knew forums like this where about,never knew you had to get forms checked ect ect. I was petrified i had done something wrong,every imaginanable thing went through my mind on the day of court.


    I had made one mistake on my 2:o pages of unsecured debts. I had put totals on each page instead of doing a grand total on page 2. The worst thing was when she asked is that............. and there were others in the small clerks office:o :o:o who heard my disgusting total:eek: .


    The moral of this rather long winded tale is that we all no matter how clever,informed ect think our bc is going to be refused for one thing or another. I think thats why we do breathe a sign of relief when we walk out of court.D

    Hi anne, i don't know the specifics of br so can't really help. but ican say that now my hearing and interview are over i do seem to feel so very much better. EVERYONE i dealt with in the courts and even the OR have been very very nice, and i am in similar situation to you as in being on benefits etc which i think does help as they knwo you don't have spare money...
    when i have a bank a/c up and running i will be much better still...
    don't know about every overpayment etc but i have heard that there is a new ruling which says that benefit overpayments and loans will be written off at the end of the br - when discharged. my OR confirmed this but said there are different situations so to check it with them.. haven't done that yet but feel pretty hopeful that my budgeting loan and a 1000 overpayment will be written off within a year...
    i'm off now, back tomoz, night night, try to hang in there, one step at a time as i was advised, and of course this amazing place to help you too.

  • my rent arrears are being taken into account and im under the same suspended possession order. Ask about overpayment of WTC, might get lucky since its their fault not urs.

    Debts incurred through illness and homelessness, starting a degree in September, going bankrupt in November and having a well deserved fresh start in January 2009! Bring on the new year! Interested in thrifty living, and if its green all the better for it! xxx

    Hi Anne,

    The reason you have to pay £ 5 per week to your rent arrears is to comply with the possession order to avoid eviction. Perhaps what I havent made clear is the fact that those rent arrears ARE still written off in your BR. Its a bizzare situation but you will be paying £ 5 per week to rent arreaers that actually do not legally exist !

    If you dont pay ( perhaps if you move out to live elsewhere ) then the terms of the possession order will be breached, however as the amount owing has been written off in your BR then you will not be chased for the outstanding amount - hope that makes sense !

    Also if your tax credit o/p has been calculated and demanded before your BR then it too will go in to your BR as will any other benefit o/p.

    Phew just under 48hrs to go am getting nervous but god I cant wait..

    Do I just have to take my petition and SOA to the court or lug all my paperwork as theres a chance I might be seen or talk to the OR after I have seen the judge?

    Plus how many copies 2 or 3 seems to differ from court to court. Sorry Im asking daft questions Im worried incase I miss something.

    Oh and a P.S. added have just come of the phone with the Coop and they have accepted my application and she said if I dont hear from them in 5/7 days to ring them so fingers crossed
    One thing puzzled me..she asked if any of my creditors in BR was the Coop or associated companies?? I know its getting more difficult to get a Cashminder acct if you owe the Coop itself money but associated companies who or what are they, are they other businesses under diff names owned by the Coop, and if so do you know who they are???

    Hi Anne

    Give your court a quick ring. They usually ask for 3 copies but some are known to ask for 1 and copy them for you. They ask for 3 as 1 goes to the OR,1 for the court and 1 for yourself. I was a right numpty as i also did one for myself as a spare:o ,then they gave me one.lol

    No you do not need all your paperwork,the OR will send for that when he/she is ready. Just some pennies for a drink and maybe a magazine or a book. Oh and the fees:D

    45hrs and so many minutes/secs jeez the times crawling think I shall do some theraputic cleaning and go and clean the oven and achieve something instead of mooching around watching the clock

    I have my nephew tommorow and my sis is paying fe us to go to see Dark Knight the Batman film (Orange Weds 2 for 1 lol she reads the DFW thread too) so that will pass the time.

    Right rubber gloves and the can of Mr Muscle Oven Cleaner I got for my b`day pressie of sis ( well might as well have practical useful gifts:rotfl: ).

  • 15 hrs to go then its all over I hope....jeez the time is dragging I have lovley clean windows, a shiney clean bath and all my curtains have been washed and ironed.

    Just need to get money out of bank at midnight then this time tommorow it will be all over I hope.

    Just need confirmation that my Cashminder acct has been approved then life may look a bt more rosy...

    Think I might go clean out under the sink this waiting for Bankruptcy tommorow is resulting in lovley clean flat.
