What defines acceptance of an upgrade?
Last night i spoke to t-mobile about 1 of 2 contracts i have (both of which are my two daughters) as to what they would offer etc. The contract officially ends 13th Oct so i could give notice to end on 13th Sept.
They offered to scrap the £70 buy out charge for the remaining two months and give an allowance/offer which my daughter was happy with and the LG Viewty. (£7 delivery charge though which i was quite stunned at, thought it was usually free).
The phone got delivered today and has been opened to charge the phone up and turn it on. Does this mean she has accepted the new offer/contract? She hasnt made or received any calls/texts. She hasnt used the camera or anything else either. She has just been using the menu systems etc to see how she gets on with a touch screen phone which she thought she would like, but has now learnt she doesnt like it.
When i spoke with the man yesterday he said that there was 7 days in which to make your mind up. So if she can return it will she be able to carry on with the last two months or will they just bill her (or me i should say, although she pays me the money) for the £70 and she has no contract left?

you have 7 days to return it under distance selling law. If you return it you should revert to whatever package and deal you have before ie cancel on the 13th sept. They werent doing you a favour tho "waving the £70 buy out charge" its standard practice with tmobile direct that you can upgrade early!!!0
