The deposit is the tenant's money: the LL should keep it in a separate account from the ones used for running the other aspects of letting (& one of the deposit schemes is custodial, which means that the LL actually has to hand the actual deposit over to the scheme administrators). Amateur LLs who do try to use tenants deposits in this way are likely to be the ones who then can't repay when the tenancy is up & rightly find themselves on the receiving end of legal action..You think he could take the deposit off them before they moved in, used that money to spruce the place up, and then generate it again before they moved out? Or is this not allowed?0
