I agree with all of the above, ie the moment the money changed hands the house, the garden and everything contained therein became yours. Tough t*tty to them, they can't have it back as they sold it to you. I'd get your solicitor onto it in any case, to clarify in writing the legality of the situation their solicitor and to you. Cheeky gits!

Totally agree with the above. Its yours to do with as you please. Inform them, via your solicitor that you would be prepared to sell it for £40k or something daft, that'll soon shut them up.

As an aside, when we moved into our house, the sellers had tried to get us to pay an extra £500 for carpets that were well old and minging, so I kindly declined and said they could take them with them. (can imagine how well that went down!)

Anyway, they rang to say on the day we were moving could they leave them coz they didnt have time to take them up. Cheeky sods i thought, so i told them to take them with them coz they were going to the tip anyway. So when I get there, sure enough they are gone, as were the lightbulbs and curtain rails (they had agreed to leave but it wasnt in the particulars - lesson learned on my behalf there).

When i went into the back garden, lo and behold, there were the carpets! That made me quite annoyed, so, into the back of the van they went, and then got dumped on their new drive. She came out saying "you cant do that!" so i says "lucky i'm not charging you storage and delivery costs!".

That was the last we heard of them!

Stick to your guns though, its your shed, hit them with the law.
  • This is ridiculous!!! How the hell can they come back and say it's theirs?

Next week, they may come back and say the guttering is theirs and the "bloke who was going to take it let them down". The following week could mean you lose your roof tiles..................and so on

Also, even if they did take the shed, who pays to get the certificate for the change in wiring to confirm safety? Who is liable?

I would ignore them totally. If they go legal, do the same. If they have any sense (sounds like they don't), they will realise the cost implications of the legal route and leave you alone...............

This idiot approach from sellers really pees me off ........grrrrrrrrrrrrr
  • i was also wondering about somethinglike this although the house was not mine and it was curtains not a shed.

Basically we were renting a house of a family member of OH, it all got very messy when they put it on the market wkthout telling us so we upped and moved out, they asked if we wouldn't mind leaving curtains till new buyers moved in so no-one looked in and they would be returned on completion, went past other day and the new owners have moved in and MY curtains are still up, phoned nan got her to speak to so called family member and they just said "oh they have been sold with the house"

Wouldn't mind but some were very expensive, one pair cost £300 alone, but i don't have a clue where i stand, i have no recipts to prove they are mine and its not like i can knock on the door and say "there mine, give them back" Now i'm so glad i took all my light fittings now.

You still own the curtains not them - your landlord never had title to them to sell them on. Not only can you allege that your landlord has committed theft and the tort of conversion, but you could take out a civil claim against the current residents for the curtains (a claim for delivery up of the curtains, alternatively damages, based on conversion). I suggest you write them a letter in fairly pleasant terms setting out the facts, suggesting that they give them to you rather than you having to go to Court and that they take up the matter with the Landlord (if the curtains were stated to be included in the purchase). The difficulty is proving they are yours (as you already have picked up on). Do you have any photos taken of you in the flat with the curtains? Do you have an inventory not stating curtains?
