Vendors want shed back after completion

    i was also wondering about somethinglike this although the house was not mine and it was curtains not a shed.

    Basically we were renting a house of a family member of OH, it all got very messy when they put it on the market wkthout telling us so we upped and moved out, they asked if we wouldn't mind leaving curtains till new buyers moved in so no-one looked in and they would be returned on completion, went past other day and the new owners have moved in and MY curtains are still up, phoned nan got her to speak to so called family member and they just said "oh they have been sold with the house" :mad:

    Wouldn't mind but some were very expensive, one pair cost £300 alone, but i don't have a clue where i stand, i have no recipts to prove they are mine and its not like i can knock on the door and say "there mine, give them back" Now i'm so glad i took all my light fittings now.

    I have to be honest and say that they designed the garden as the log cabin being one of the main features. Without the log cabin it doesn't look half as good. You can use this log cabin as another room.

    Apart from the other issues raised here, this would mean the log cabin is an intergral part of the property, not just something erected on it. This would also prevent them being allowed to remove it and had they indicated they intended to, you had good ground to disagree or ask them to reduce the price of the property accordingly.

    Seriously, if it wasn't in the fixtures and fittings as an item they were taking with them then they can't then decide to take it. You have completed.
  • Was the log cabin mentioned in the details you got from the estate agent?
    It seems bizarre to me, a bit like asking for your prefab. garage back.

    Even if they had said they were taking it with them they had to get it out of the garden before completion. Now the shed is trespassing and you could charge them storage. If you did have to give it back, you can choose who removes it at their expense. They would also have to make good and safe any wires etc.

    Your curtains are gone and your recourse is against your former landlord. Send them an itemised bill for the curtains and threaten to sue if they don't pay up. Normally with family I wouldn't say to do this but as they didn't give a stuff about you with regard to selling I wouldn't worry about their feelings.

  • Second Andrew's advice, if they wanted to pay your legal fees/stamp duty/pay off the mortgage etc, then you get that shed down ASAP, else you and they know where they can go!

    The log cabin wasn't in the details but i think i mentioned before, that on visiting the property twice, we went out into the garden to be shown around the shed and we were told that it was staying and how it has electricity so you can put a tumble dryer etc.. if we wanted to. Also the photos of the property showed the garden with the log cabin in it.

    lists of fixtures/fittings do include outbuildings/sheds or anything in the garden, as some people are known to remove all the plants when they leave, so they have to sign to say what is being left

    Also if the shed wasnt included in the sale, this should have been indicated in the estate agents details too

    They couldn't come back and take away your bath or your fence or your kitchen sink so why would they be able to come back and take away your shed/log cabin?
