    You've taken out an agreement for 12 months and now you want to cancel. If you have 6 months left on the contract you owe them this money.

    You could try visiting the club and speaking personally with the manager to see if she is prepared to help in this matter.

    ur original contract was 12 months with xxx notice period, anything up to 3 months...

    Esporta are terrible, I had a 12month contract with them that they explicitly stated would end after 12months, all I had to do was tell them and cancel the DD. I did this and forgot about it until I got a letter from a debt collection company wanting 3 months fees plus their charges!! They said I had to pay for the 3 month notice period even though they had explicitly told me and my friend that joined that we could cancel after 12 months with no notice period at all.

  • I had all of my belongings stolen from locker number 10 in the male changing rooms in Esporta Croydon on Wednesday 30th June at 8.30pm, and the locker was completely locked when I came back from my workout leading Sutton Police to suggest that it is most likely someone with a master key who did it, such as gym staff. I lost about £800 worth of stuff including an iPhone, expensive designer glasses. I signed up to a 12 month contract in April, so still have 9 months remaining. It says in the contract that I can only cancel if I move out of the area, are made redundant or have a GP note. However, I feel the gym is not secure, I have to put my belongings somewhere, and despite the high membership fees, they do not have CCTV inside or outside the changing rooms (although CCTV is all over the rest of the gym). Do I have any rights to cancel my gym membership, as the amount lost is more than my yearly gym membership fees, and I've simply lost so much, I don't want to pay for the gym anymore, especially as they are not putting anything into place to stop it.

    It is a really difficult post to read, OP... but it sounds like you were already cross with them earlier in the year, but still chose to re-join in July! Why?!

    Was yours the only locker entered and have they had any other incidents that you know of?

    I don't think Esporta could be liable in these circumstances. The best course of action is to claim on your household insurance.

    I don't think your circumstances are grounds to cancel your membership but discuss this with the club.

    For what it is worth I am an Esporta member. We have had a few similar incidents at my club over the years but the club has always regarded security as uppermost.

  • Thanks Art, I've tried to claim on my household insurance with Endsleigh, but am not liable as it only covers contents within my property, I am going to upgrade this following this experience. There were a few similar incidents a few months ago, and many incidents in the car park with break-ins. I haven't been to the gym since because I simply cannot afford to lose another £800 (iPhone + expensive spectacles), I have to put my belongings somewhere and you want to be able to trust the lockers.

    There are so many of these threads on MSE, I have no idea why people would sign up for these gyms on such long contracts that seem to be water tight. Many areas have fab council sporting and gym facilities that are really reasonably priced and you don't have to pay a massive 'introduction' fee, I really don't understand the logic of paying £30-40 a month to use a gym? :eek:

    People sign these 12 month contracts, don't read the terms and conditions and then try and get out of paying after a few months when they realise how much it's costing them. Unfortunately you signed a contract and you have to pay.

    In regards to the OP the Esporta website states

    7 How can I resign from my membership?
    If you want to end your membership, you must give us at least three full calendar months’ written notice so that your membership will finish at the end of the third month. For example, if you tell us on 1 June, your membership will end on 31 August, and if you tell us on 8 June, it will end on 30 September.
    If you tell us during the minimum term, your membership will finish at either the end of the minimum term or the three month notice period, whichever is later.

    Did you follow these steps and can you prove it to Esporta, you're original post is a little confusing so I'm not entirely sure. Hope you get things sorted, as from what i've heard these gyms won't stop chasing you for money.
  • use this site to get out of contract it worked for me, http://www.debt-trust.co.uk/index.html this site got me out of the mess, otherwise try other no win-no fee sites there are many around
