Screwed by esporta Help please.

Hi, i am a student and work part time to to make some living. Well i joined esporta about 8 months ago but due to financial circumstances i tried to cancel my membership by filling up their membership cancellation form and canceled my direct debit after 6 months but then they started bugging me and sending letters, by that time i was so busy in studies and work i had no time to join back, however i paid them 2 months dues plus fine and then 56 pounds for next month which was June this year.

Now amazingly on 3rd of July they deducted 118 pounds through DD when they were supposed to charge 56 pounds and i had no clue about this deduction till the mid of July when i decided to join back gym and figured their system is not letting me go in and on inquiry on reception desk they told me i have not paid for month of July, i apologized and left for home and assured them i will pay them tomorrow, luckily i logged onto my online banking and saw a charge of 118 pounds by esporta group.

From this point till now i have made about 2 dozen calls to their head office + esporta ilford and they make false promises about looking into the issue and getting back to me, in addition to that i have paid several visits to their facility to sort out the issue and get the refund ( remember mean while they did not let me use the gym ) in start they refused to admit i have paid then i brought my bank statement and showed them even then they did not believe and asked me to bring espn number for which i had to go to my bank queue up and get it for them.

I then brought that espn number for them and they assigned some manager to sort out this and promised to call me after 3 days on friday which they never did so on saturday i went to them again and found the concerned person is gone for holidays and will be back next week.

Next week comes and goes and no sign of the manager or any cal from esporta, i went to them once more and met concerned manager and he was " oh well i was on holidays and now i will fix your issue and give you the refund but you have to wait " He promised to call on thursday which he never did and on next monday i found he left for 1 month holidays.

Then i got in arguments with one of their manager on phone but they refused to help and said only concerned manager can help and since he is on holidays i must wait, i hung up phone and called head office, they also refused to help and told another managers name to speak with in Ilford Esporta, so i called back in ilford esporta and spoke to the manager and first explained her whole story and then she said she will get back to me on thursday ( thursday is their special day) and as expected i got no call and by then 5th of july i got charged for another 118 pounds, now i just called them and ask them for an update on this issue and reception guy is telling me she is very busy and will get back to me later.

I am like this :mad: :( atm. I am student and cannot afford such losses, Please help me get my refund from esporta.

    Im sorry but I found that very difficult to read. However from what I can gather Esporta have made a mistake and taken more than they should from your account using a direct debit which you had previously cancelled with your bank

    If that is the case then you should be covered by the Direct Debit guarantee get onto your bank for a refund

    Difficult to read because its too long or just poorly written ? :D. I am with halifax so what would be the procedure to file a claim and how long does it take ? and what sort of docs i would need to provide to bank ?
    Help appreciated.

    Just go write to your bank with the salient points i.e. that they have paid a direct debit that you had previously cancelled and you want a refund !

    That however wont get you off with Esporta as I'm assuming you originally signed a 12 month contract, which is the usual thing with gyms. That will be also more than likely be a credit agreement and you will probably find they want full settlement of the remaining period. See what your original contract says

    Ok let me explain again, i had canceled my DD in april but then activated in july and that is when they charged me 118 pounds instead of my regular fee which is 56 pounds, now they have done same this month, amazing thing is they are not admitting to it.

  • hii... I am also a student. i was earning from a part time job and had taken esporta membership. I had only 6 months left for my Visa in UK so i wanted to have it for 6 months only. When i saw in the contract that it is for an year, I DID NOT ticked that I agree to the term and agreements... Now Due to the recession stuff, I have lost my job Its only 2 month since i joined esporta so i called them up to tell the situation and cancel my membership as the staff told me that if you loss job you can cancel the membership..Also they told at the time of joining that you can cancel after 6 months..They Are very flexible with Students !!!!
    Now i talked to the esporta manager and she told me to get the termination letter and i mailed her a copy only to get the reply that they are unable to cancel it because U have not been made Redundant... I mailed them that as the membership is on dispute , I am holding it undersuspension and cancelled the direct debit... Now I have received a letter asking for 70 pounds ..50 pounds and 20 pounds fine. Can any one help me in what steps i should take.. To get the membership cancelled... Or I will simply leave everrything.. I am too bankcrupt now to pay membership to them...Please advice

  • ya i send them the cancellation e-mail till date.. Please advice as what to do ...Do they consider email as a valid cancellation method...
