Gas Safety Certificate out of date by 6 weeks...where do I stand??

    Health and Safety at work Acts put the onus of responsibility for health and safety clearly on the shoulders of both providers of equipment (employers for example) and workers to workwith /use equipment in a safe manner.

    Landlords have a Duty Of Care to tenants under H&S legislation.

    i surmise that if a gas appliance has been inspected and then taped as "UNSAFE DO NOT USE" by a CORGI gas engineer, then the tenant would have some culpability for their own misfortune if there were to be injury or death.

    If this inspection has not taken place, how would the tenant know the equipment was faulty ?

    btw - the regs say that a LL does not have to produce the Landlords safety certificate for either 14 or 28 days (cant quite recall which) after the inspectoin takes place

    With regards to your post above, it's not rocket science! The whole heating system makes this loud and continuous knocking noise when switched on. The boiler sounds like it is "kettling" (learned this term from a colleague). There are 2 switches marked CH (central heating) and HW (hot water). The CH switch does not work on its own - only comes on when the HW switch is on. And hey presto, we have a ratting house!

    After the hearing in December 08 (gas cert expired in August 08), the LA sent someone over who said that it merely required "bleeding". He tried to bleed the radiators and there were problems. I mentioned a gas check - he seemed surprised that one was not done. He did one, said that he had concerns and needed to come back to service the boiler unit, etc.... but still issued the gas cert.!!!

    He came back a week later, did nothing about the (still noisy) heating system, but fixed the dripping from the loft which was (apparently) due to a faulty valve or something.

    Private Tenant Officer??? At the local council??? Well I never... only just knew about this! I though the council just collected "free tax", i.e. council tax :p

    That's all a gas safety certificate is - a certificate showing that the gas appliances have been checked as 'safe' on a certain date. It doesn't mean that the boiler has been serviced, or indeed is working efficiently.

    How can it be deemed to be "safe" when concerns were voiced??? How can one issue a cert when that same person voiceed concerns???

    Sigh!!! That's te UK for you!!!
