Good advice about Pepipoo, 1st time I've heard that a private parking mob can issue ""laws"". Pity you wasted you time appealing, its probably just another box on the same desk as all the other rubbish. They never allow appeals, it would mean they have less chance of conning you out of your hard earned cash.I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0

How long did it take him from leaving his car to finally entering the supermarket??(Some of this is largely irrelevant as casey has said) I would think it possible that the landowner may not necessarily be the supermarket,but I agree the supermarket would probably not envisage their carpark being policed in this way.
What was the wording that described what you were not allowed to do?
The supermarket wasn't aldi or lidl by any chance?
Securit i are at present an approved operator (ha!) of the bpa (british parking association).If you look at their websites code of practice for approved operators (parking tickets) it says the underlying philosophy is that operators have to act"reasonably" ( is this reasonable?) and at some point I would consider reporting them to bpa for breaching the code of conduct,as they say that this would be the underlying principal in judging any complaint-(ignore the rest of the rubbish thats written regarding enforcement).I would also write additionally to the supermarket pointing this out.0 -
Thanks hollyday, The ticket was issued at 13.34 and the time on my husbands receipt from the supermarket (Booths) was 13.46

OK the legal position is that you probably breached the terms of the contractual licence allowing you to park at the carpark. However:
1. Ask to see what these terms are and what they allege was the breach;
2. Ask what actual losses caused by the breach have been caused.
3. If the allege that the charge is a liquidated damage, ask them to justify how it is a genuine pre-estimate of the loss likely to be suffered by your breach. Remind them that if it isn't then it is a penalty which is unenforceable under English law.0 -
You have evidence to prove you made a purchase at roughly the time the ticket was issued.
Do they have evidence (other than the eye witness evidence of the parking attendant) to suggest that you did otherwise ?
Try a little bit of R&R..... nip down there, see if the attendants are armed with digi-cameras. They might have a timed shot of you at he bus-stop. If not I'd suggest they wouldn't have a hope in hell of getting the money off you. 12 minutes between the ticket and getting to the till ! Without additional evidence any small claims court would laugh them outta the place.0 -
Eye witness evidence in many cases is often perfectly acceptable,particularly when its the persons job.Caseys post is most relevant though.0

There is no evidence required either way. There is a sure fire defence to any claim based on sound contract law.0 -
Just an update on the situation with my 'parking fine' - we have written to the Supermarket concerned and have had no reply whatsoever. Today we have received another letter from securi -t advising that the payment is no longer £70.50 but has been raised to £94.00 and this must be paid by 4th September or it will be passed to their collection department!! Do you all still think we should sit it out ??0

Get onto the Pepipoo site and ask there, they have legally trained people who will reassure you that you can ignore them.I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0

I've had a parking charge notice from those nice people at Euro Car Parks some 5 weeks ago, but no letters yet.
Plenty of good advice on CAG and Pepipoo, as highlighted earlier.0
