    Ok just in case anybody else would like to venture along the same path as me this was my intention.

    As far as I can see Virgin's legal dept have let them down on this one again but I have not had opportunity to check it out thoroughly yet perhaps someone else might as my daytime hours are very limited at the moment.

    The offer that Virgin is making {if I am right} is further impinging on our rights as consumers insomuch as it puts unreasonable restrictions on our ability to gain our loss of bargain,

    "If you are able to buy this exact item from any other"

    "we will happily refund the difference between our original
    £32.99 price and your final purchase price (up to a maximum of the
    recommended retail price of £89.99)
    "

    "A response to this e-mail, only once you have purchased the item from an
    alternative retailer as specified above."


    "Please do not contact us before your purchase is complete, as we will be
    unable to answer speculative questions.
    "

    again if I am right we should have the option to buy ANY console of a similar spec irrespective of make or model if the chosen item is unnavailable,

    If I am correct then there would be no need to panic and risk purchasing an item that virgin may reject as innappropriate at a later date, they are certainly not in a position to deny you the option of making pertinent enquiries as to what may or may not be acceptable alternatives, yes there will be limitations but these are set out in guidelines and legislation not manufactured by Virgin solicitors to meet their specific requirements,

    It would be really helpful if someone could run this by T.S. as although I hope to do so myself I didn't manage it today and cannot be certain that I will tomorrow.

    OK delighted to see Virgin have relented on this what chance of Woolies and Tesco doing likewise ???

    I would't be too hopeful of Woolies and Tesco coming through with anything en-masse as they didn't take a payment from most, however anybody who did have a payment taken from their card should be in exactly the same position as Virgin customers.

    You might try seeking some kind of shut up offer from them by way of vouchers perhaps but knowing the stance Tesco have taken I would be surprised if you even got that!

    Can someone answer me a question?

    Will a despatch email from Amazon (when I get it) be good enough to attatch to my email to Virgin?

    Or will I need to scan the one I receive with the goods?

    (thank god I ordered from Virgin as well as Tesco! ;D)

    Cheers for the calrification scumgrinder :)

    I ordered 2 from Virgin using 2 different accounts (to try to get under the radar). However I ordered my first one from Amazon before they ran out so the first will arrive this week and the second a week later :-/

    While IANAL, I must disagree with you.

    What Virgin have done is actually very reasonable and I don't think any reasonable court in the land would rule otherwise. Each restriction exists for a very good reason and is not onerous in the slightest.
