TalkTalk recently moved to a Dynamic Shaping Policy. This means that trafic is shaped according to available bandwidth at anytime. At peak times on busy or congested exchanges p2p can be slow or non-existant. I might be lucky with my exchange but I can get (compartively slow) connectionns day & night but still get fast connections overnight. There's more info on the Members Forums http://www.talktalkmembers.com threads and help pages but here's a flavour of the policy:

"Basically we didn't shape in late evening hours but shaped agressively during the day to preserve bandwidth for customers browsing the web etc. Now we shape 24/7 but instead of it being an agressive cut off during the day the system looks at the available bandwidth on the network and will allow P2P traffic to use bandwidth were its available"

Unfortunately you'll find nearly all ISPs doing this to P2P traffic. Not many will have a case to complain as the amount of legal file sharing done on these programs is less than one percent.

my isp (vivaciti) doesn't shape p2p, but it does cost £20/month for 30gb peak, 300gb off peak, so more than many here are prepared to pay
