  • Hi there - please could you give me some urgently needed advice. I owed Birmingham City Council about £160 (i think) council tax, this ended up being placed with Equita andI agreed to pay £20 a month via direct debit - this payment plan was set up in Jan this year and has run like clockwork until today. My last payment was refused to go out by my bank as a bank charge (another bugbear) left me with no money in the account. I did not realise this until monday this week when I went to discuss with the bank manager. I assumed Equita would simply try again after a few days to take the payment. Today a bailiff from Equita turned up while I was out and spoke to my partner - my partner explained about the bank problem and offered to pay or asked if i should pay over the phone when i returned - bailiff said this was not acceptable and he would be back later (3pm) to remove the goods from our home. I telephoned the bailiff straight away and offered payment - he told me Equita would no longer accept payment on my account and he would be back later - I told him that my partner owns all the goods in the house and was told it didnt matter an he could remove them anyway. The letter he left with my partner said to phone him to arrange to pay but he has told both of us that this is not an option! I telephoned Equita only to be told that they couldnt discuss it and to deal with the bailiff - even though I tried to explain that he himself wouldnt discuss anything other than removal. He is due here around thetime my children come home and I dont know what to do!! Its only one payment missed (£20)and Im offering to pay it right now - please help

Have you ever previously let the bailiff in your house? Have you signed a walking possession order??

Did he gain entry to the property?

If not, i would advise not letting him in and make sure all windows and doors are locked. They can come though an unlocked window or door without invitation - this is known as peaceful entry.

You say he discussed this with your partner? I'm not sure, but i thought that they couldn't discuss your debts with anyone else.

Have a look at the bailiffadviceonline site above and also try PM'ing Herbie21. Hopefully she will be able to advise what to do. Also do a search on the forum for council tax and bailiffs - i'm sure alot of questions you have will be answered in the posts.
