my friends as been with them for 15 month but the contract was renewed in june for another 12 month, he said he was not aware of the renewal , in june he asked for an upgrade to up to 8mb

iam i right in thinking by law the cost of cancellation should be in their t and c , which it is not, many thanks

    FWIW, looking thru their T&C:
    http://www.toucansurf.co.uk/site/terms.aspx

Section H1.1 and H6 are relevent. H6 does cover their ability to charge for remaining period of any fixed 12mth term contract if I have read it correctly for contracts which are terminated early.

Accepting a new modem/router or speed regrade would constitute a renewal of the existing contract for a further fixed 12 months term. This is normal Tiscali practise (Tiscali own Pipex and Toucan).
