How long should it take the police to respond? Updated - advice needed please

  • just calmly tell them what happened

    as you didnt hit them they will have no evidence (lets hope shes not suddenly got someone who saw it all)

    with any luck she will have a history of doing this and will be on record

    A couple of years ago I had a similar problem. Someone claimed they had seen me hit their car when I was parallel parking (they didn't because I didn't). They didn't approach me at the time, they just left a letter on the windscreen saying I'd hit their car. So I went straight to the police and said that I had not had an accident and asked for a report number so both sides of the story were logged.

    They had accused me of reversing into the passenger side front of the car, when parallel parking (by a fence) if I had hit them I would have to have hit the drivers side, as the angle would have been impossible for me to hit them where they said without knocking the fence down.

    They were just looking for someone to pay their repair bill and decided to fit me up. When I tried to look at the car myself I found that the owners had hidden the car away, so I asked the police to check whether my car could possibly have done the damage (which I knew it couldn't). After a while the police realised that I couldn't possibly have done the damage and went away. I have no idea if they prosecuted the others for wasting police time but I hope they did.

    Ok so I just had a policeman knock on the door wanting to speak to me about this bloody incident, I've arranged to go tomorrow.

    Yeah he's 7 weeks old now, going to have to take him with me tomorrow, hopefully he'll be good.

    If they ask you to make a statement.if you are just a witness,it is a normal statement.
    If they think you may be guilty (probably may at this stage),it will be under caution.
    They usually offer to write the statement for you,or they can help you by advising you what to write,this is fine for you to do it this way if you want. there is no need to hurryand if they write it,you will be asked to read it-if there is anything you don't agree with,ask them to change it,because you will be asked to sign it.

    It is quite useful if you had any notes you made at the time.If you did,you can take them with you and the police may also submit that as evidence.You could take a copy of these original notes so that,if it went as far as going to court,you would be able to refresh your memory with the exact events that happened,and the exact words you used (use the same words in your statement)Otherwise ,when you get to court,you would be given your statement to have a quick look at,it can be hard to remember exactly what was said,if you are cross examined you will have the advantage.

    When I got the first letter I wrote down the all the little details of what happened which runs to about 5 pages, I'm glad I did now as I doubt I'd remember much about what happened 4 months ago otherwise, I'll make sure I take it with me.

    He said it'll only take about an hour, I don't know if that's a good sign or not?

    I think the law say you can only use notes that have been made up immediately,or as soon as practicable after the accident.

    Given the OP made the notes as soon as she was aware of the claim of an accident I’d think they’d be fine both for submission as evidence and to help her remember events etc
