Many years ago I took an additional 2 A levels at night school and due to a fmaily problem I never sat the exams, however it never occured to me to ask for my fees back as I had been attending three evenings a week, I had received all the print outs and book lists, had attended lectures and had my course work marked..so I had benefitted from the course even though I never actually got any qualification out of it.

What an extraordinary story!
I am quite sure that the student (OP ) is obliged to pay all the fees in question. The liability to pay begins as soon as you register at the beginning of each academic year.
However, I suggest seeking the help of the student's union, who should be able to negotiate some arrangement whereby late submission of the missing/failed work and eventual graduation is permitted.0
