To answer the OP orginal questoin - if after 6 years the bank has not noticed the error or requested the funds to be returned then you can legally keep it.

You could put it in an instant access account and earn a bit of interest off it. That way if/when they ask for it back you can return it with no problems.

They will find out about it in the end though.

The only problem with that is that one member here posted that the money was simply taken back while they were on holiday so it would seem wiser to leave it where it is.

Tempting as it is for you to keep the money I'd get onto the bank A.S.A.P as has already been said you can get done for theft if you don't inform them quickly!!

My friend had this happen to her and she rang the bank and told them as soon as she realised, she also went into the branch and spoke to the manager and wrote a letter, the money was in her account for 3 months until they took it out!!

Don't take any chances, tell them straight away!

i like the 'invest in a high interest account'....only problem is bank may take it out without any notice which could send you into an unauthorised overdraft! wouldnt be free money then!

  • I personally would leave it as it is and dont mention it to the bank. You cannot get into any bother for that, its not your problem and it certainly is NOT THEFT.

If you came and parked your ferarri on my drive, left the keys in the ignition then didn't bother coming back for it does that mean i've stolen your car?. NO!.

If its a mistake they will take it back when they are ready and in the meantime you could be earning some interest on it.

I certainly wouldnt condone withdrawing it, concealing it or trying to spend it as that really is theft and you could feel the sharp end of the law for that.
  • i went to the bank one day and found £90 extra spoke to bank it was a pension payment they did not want to know as the compay had made the error not the bank so i was 90 pound up.
  • you are taking a risk - after some time you may forget about it until the error is discovered & they debit you & possibly taking you o/d with everything that entails

That's what I was thinking, the bank will not give you notice before they retrieve the money from your account, so if you are low in funds when that happens, you will go overdrawn and that will cost you.

Besides, there is someone else out there whose money this is, and he/she may need it desperately. I know there are those who think "tough", but when they themselves are the losers, hear them bleat..
Be careful who you open up to. Today it's ears, tomorrow it's mouth.
