They would still need to prove negligence though.

As to what you'd cover it under, I'd be suprised if EOW peril was worded to allow anything other than plumbed in fish tanks to be covered, so IMO it would have to be under AD.

I agree - generally only fixed water installations

Thanks all,,its really only come to my mind with 2 other tank owners i know they leaked,,there insurance covered them for the carpet etc,,not the tank which i would expect.

The council will be insured for the building damage,,but i suppose im more worried about the neigbours contents,,a nice big 42" and leather sofa just turned up right below where the tank would leak to

I think ill have to ask the company,,the council just sent out quotes for tennents for there home contents insurance under writen by .royal & sunalliance.which not bad 15k £144 a year no excess to pay, with accidental damage.

    So confusing,,

You'd only be responsible if you were negligent in allowing the damage to occur.

i suppose then that goes for if the tank went through the floor with the weight. If i had a structual engineer who said "it will be fine" id be covered.

They got you in every way insurance companys

I suppose if a washing machine did the same and leaked to underneath it would be different.

thanks everyone,im still open to more comments as the more the better

The insurer i work for accepts that large fish tanks (ie unable to be carried - which covers most apart form a kids goldfish bowl) that leak are fixed installations and therefore damage done by a leak from said installation is covered under EOW.

Surely no need to prove negligence, would not liability be enough?

No, in simple terms for this kind of situation there is no liability to the neighbour unless there has been a breach of tort eg negligence.

OK Thanks, I'm a layman when it comes to legal matters.

only helps with part of the question, but when our fishtank front blew our insurers had a really nice new one sent straight away, and replaced the floor. It had been our fault - the cabinet was insuffucient to support the weight - but they were great and really sympathetic. When they sent someone round all our fish were living in casserole dishes!
