33 Not exhibiting licence
(1) A person is guilty of an offence if—
(a) he uses, or keeps, on a public road a vehicle in respect of which vehicle excise duty is chargeable, and
(b) there is not fixed to and exhibited on the vehicle in the manner prescribed by regulations made by the Secretary of State a licence for, or in respect of, the vehicle which is for the time being in force.

147 Not exhibiting licence: period of grace
In section 33 of VERA 1994 (not exhibiting licence), after subsection (1A)
insert—
“(1B) A person is not guilty of an offence under subsection (1) or (1A) by
using or keeping a vehicle on a public road during any of the 5 working
days following the time when a licence or nil licence for the vehicle, or
a relevant declaration applying to the vehicle, ceases to be in force, if an
application for a licence or nil licence for or in respect of the vehicle to
run from that time has been received before that time.0 -
Those buying their vehicle tax online or by phone will now be able to tax on the last day of the month and still be able to legally continue to drive their vehicles for up to 5 days while they wait for their new tax disc to arrive. This will only apply where the new tax disc has been applied for before the current one expires and motorists should continue to display the expired disc on their vehicles, until the new one arrives.:j

Indeed, 'tis true enough, however, there is no need to continue to display the old one as 'tis dead and buried.
And the DVLA number to replace the expensive 0870 number above is

And if you get clamped or ticketed you should get on the phone to DVLA & threaten legal action for tresspass (in the event of the DVLA clamping you). In the event of a ticket, either write to them to ask for it to be cancelled, or allow it to go to court - and use the mitigation procedure before court date - and then fight your corner if they proced to court.0 -

I came to the same conclusion, and I also thought that the bit about displaying the old one is probably made up by someone at the DVLA who wants to make life easier for their clampers.
They don't clamp anyone without permission (via their mobile computers in the vans) anyway, so the computer would tell them that the vehicle has tax that has only recently expired.0
