    I would suspect though, that clocking up a virtual "40,000 miles" on a laptop may be defined as approximately 6 months (say?). The driver might be a rep driving 60,000 mile+ each year and that the car may have only been 6-8 months old and that could be short enough to finally reject a car. How that would work with a laptop, I don't know, but if you find a recent case study involving a p****d of consumer taking a retailer to court, then let me know, especialy if the laptop has done 40,000 miles! ;)

    I should of made it more clear, that I was covering options for 'nearly_an_angel' to take before it ever gets to court!

    Like uktim29 says, at the end of the day, we just want what we buy to work and who repairs it, doesn't really matter, until both the retailer and manufacturer 'walk away' from the problem, and that's when things get muddled and expensive for the consumer and then we give up because we get no where.

    Much simpler to argue with the retailer first.

    aldi sell medion computers though don't they? also I don't think aldi are any worse than say asda?

    I had a desktop from medion which was ok, nothing more nothing less. I've had thinkpads, dells, fujitsu's, HP's and own brands. all computers can develop faults. it's how a shop handles it that makes the difference I think.

    they're certainly better than netto and other small, cheap own brand supermarkets.

    and they're doing very well too I think.

  • Who needs customers like Statler and Waldorf?
    Thankfully not all customers are as vocal as these two. Yet as a retailer, I'd rather be told I'm doing something wrong, so I can put things right ;-)

    I know everybody bangs on about the importance of good customer service, but few seem to follow through on it :-(

    The case I quoted had everything to with the topic on hand.

    Someone said the OP's rights start from the moment of purchase. I corrected this by quoting recent case law which says the period starts from the time the consumer starts to make an informed decision as to whether or not to reject - and this is not defined by law as the moment of purchase.

    (A simple example: if you buy a Christmas present in October and the product is used for the first time on 25th December, your rights begin on 25th December).

    I still eagerly await the day that you quote anything authoritative to back up your interpretations of the law, besides your old classics... "I bet" and "probably" and "I'm always right".

    I had a laptop from Aldi, it was Gericom though not Medion. The screen stopped working and I couldn't get through on the manufacturers helpline so I went into a local Aldi store and the manager there was able to arrange a repair for me. It was still in the 24 month warrenty but I hadn't noticed the small print that said the screen was only covered for 12 months, so I got an invoice from the repair company quoting something like £250 for the repair or £50 admin charge to have the laptop returned to me unrepaired. I contacted Aldi and they sent me a cheque for the full repair costs. But that's just my experience, maybe their service has gone downhill in the last couple of years

    Anyway, I don't see what the OPs problem is - the manufacturer are willing to repair it free of charge aren't they? If he wanted to persue the retailler under the SOGA then wouldn't they be complying by just sending it back to the manufacturer to get a repair? The end result is the same so I don't see why he's insisting on not allowing the manufacturer to sort it.

    I really think that if you were trying to return goods after a medium term of time, you would be making things worse for yourself. If you bought something for xmas in October, it would be reasonable of you to check the goods as soon as posible after receiving the goods (even if they were for someone else), remember you are signing that you received the goods in good condition.

    Although, YOUR Rights may start (as you say) in December, the shops Rights will have started in October!

    If you then try to return those goods in January, because the laptop didn't even start, I'm sure you would not get a refund (unless the shop was excellent at after sales service), this is because a longer than normal period would have elapsed from purchase, I would expect a repair or replacement though at the expense of the shop, certainly in the first 6 months.

    Just a thought.
