Im really confused about the whole exp thing now, i wish my councillor had just put it all together for just myself and not added my partners expenditure.

The expenditure is for two of us...a couple.

In that case you can probably add that £100 to the Food/toiletry/cleaning. The budgets for CCCS tend to allow a great deal less for this compared to what the OR will generally allow.

My GF pays 1000 per month into the Mortgage account. Thats what she contributes. Everthing then is paid for out of our account when my wages go in, ie everything hair, food, dog, cars everything.

The SOA forms are very confusing with regard to what you want to put, and the notes don't really help at all.

Basically you need to list all shared expenses and expenses that are personal to you.

You list all your income, but only add what your partner contributes to the shared household expenses not their income.

That way the OR calculates your surplus by:

Surplus = (Your income) + (Partners contribution) - (shared expenses) - (your personal expenses)

OK, so you need to put your income, her contribution of £1000, then all joint bills i.e food, mortgage, utilities etc., but only your own car costs, mobile, haircuts, etc. You cannot claim for her personal costs and car/finance costs on your I&E, that has to come out of her own money.

Some examiners will allow it, while others won't. Pot luck really.

It's listed under expenses that the examiner can "consider".
    Holidays

Previous guidance stated that an allowance for holidays should not be included in the calculation of funds available for an income payments contribution, other than in exceptional circumstances, for example where a dependant was sick or disabled. Whilst extravagance is not endorsed in this respect, it may be considered a reasonable domestic need to allow the bankrupt and his/her family to benefit from a non-extravagant holiday as a break from routine. Expensive or luxury holidays (particularly if the holiday is abroad) are likely to cause offence to creditors but an allowance of between £60-£80 per month (amounting to £720-£960 per annum) for a household of 4 people should allow the bankrupt and his/her family sufficient funds to take a moderate annual holiday. Should the bankrupt consider this allowance insufficient to fund a holiday, he/she should be informed that any additional holiday cost that he/she may wish to incur must be funded from the amount of surplus income left with him/her after deduction of the assessed IPA/IPO contribution.

My GF said she will pay my dad out of her account and reduce her contributions to myself ie 800 instead of 1000.
Thats the only way i can think of doing it??

    Hi TopdDraw

Why don't you go back to CCCS to amend your budget?

I know that they have a bankruptcy support service that can help guide you through and give you ongoing support.
