    Ok so ive spoken to CLA
    Apperantly DFD are doing this all the time when they are out of pocket with a customer ( we only paid 3 payments before we realizied it was miss sold to us ) hence they are out the court / set up costs etc etc.
    I have been told this could take awhile to sort out as they are known for there stalling tactics whilst pileing on the pressure to get some money.
    They have told me to make a formal compalint about the practioner who has set up our IVA.
    They have referred me to someone who can give me some more advice ( will be ringing me within a week )
    DFD are not breaking the law apparently ( which is soooo wrong )
    One thing they did say is that i can file a harrasment order against them for phoning all the time.
    Will keep you all posted.
    If any of you have heard of anything like this before please drop me a line, i think im going to need all the help i can get with this company.

    I have just read your thread and am absolutely seething on your behalf. DFD's behaviour is absolutely outrageous and immoral. It's incredible that this is legal. I have no knowledge or solutions to offer, deeply wish I had, and I hope very much you find some way of taking them to task.

    Thing is BR is our ONLY choice, they know this!!!!!!!
    We both work full time, have one child and one on the way and just wanted to be debt free asap.
    Guess we are just going to have to wait, just feel like giving up sometimes and as my OH says wait it out!!! But we didnt do anything wrong ( about from get into debt )
  • Of course you didn't (do anything wrong) anyone can get into debt, in fact the majority of the population is in debt of some sort. We BRs must be in the minority as we are debt-free! And you tried to sort it out with the very best intentions with an IVA, and then you were mis-sold it.

    The trouble is, someone needs some money to make a case of malpractice against them. Does anyone know if there is a professional association that they belong to who can be complained to. Are they regulated at all? Is there no way of getting back at them.

    I still can't get over that DFD are acting legally. Am still steaming, Zoe! I think I'd better go out for a while and calm down.

    If the IVA was missold can't you use that as leverage? I don't really understand re IVA'S etc but I suppose in a way you can understand them not wanting to lose out if your starting fees etc are still outstanding as they are out of pocket and are desperately trying to re-coup. That doesn't excuse them misselling or witholding though-gosh how frustrating. Could you threaten them with whoever intervenes when an IVA is misold?

    Hi Zoe

    I'm seething on your behalf as well. DFD have to be a member of one of the Regulatory bodies, so complain, complain, complain. I'll PM you a list of the bodies that govern insolvency practitioners and DFD must tell you which one they belong to - can't find it on their website I'm afraid. The list is too long to post here, but if anyone wants it, PM me and I'll send it on, but bear in mind I only log on sporadically - sorry!

    Zoe, keep us informed of how you get on - DFD's behaviour is outrageous!

    DFD are apparenyl members of the Institute of Chartered Accountants in England and Wales. Their website says:

    Complaints about insolvency practitioners licensed by the ICAEW
    Individuals must be licensed insolvency practitioners to take insolvency appointments. Not all insolvency practitioners are licensed by this Institute. We can only deal with insolvency-related complaints against ICAEW licence holders, so please contact us to find out if the insolvency practitioner holds an ICAEW licence. If you are not able to resolve your complaint with an ICAEW licensed insolvency practitioner directly, please call our complaints helpline on +44 (0)1908 546235.
