DFD Help!!!!!!

Hi again all
Im having a bit of a time of it with DFD, as in my previous posts i have an IVA with them that was started in Nov 07. Quickly realized it was misssold and after talking to NDL and reading on this site BR is our only option.
Any way we have missed 4 payments now, filled out our BR forms but our court needs a Cert ( carnt remember what its called at the mo ) to say its failed. DFD wont give it, had lots of harrassment from them trying to get money from us!!!!
Today i got a letter saying if we sign a form they have send ( something to do with putting hold notice on the house, so we can not sell it or remortgage it ) they will send us the required Cert!!!!!
I already have a mortgage and secured loan on the houise which puts it into negitive equity so shall i sign it?

Thing is this battle has been going on for months and they know we are desprate to go BR. They have been very underhanded all along ( informed my bank what i intend to do, the bank then closed my account with out any warning ) so im a bit unsure.
Any help would be fab.

Don't sign anything! Give NDL another call and tell them what DFD are doing. It is nothing short of blackmail.DX

    Thanks
I knew they could'nt be trusted!!!
The last time i called NDL they could'nt help me with trying to get this cert out of DFD!!! There only advice was to call the Insolvency group to make a complaint.
My OH says we should just wait DFD out as they are not getting any money out of us, but the phone calls ( somethimes 10 times a day 7 days a week )
is getting me down. They even phone at 9pm at night!!!!
Not sure what to do next i just want to go BR!!!!!!!!!!
At this rate the baby will be born before this is sorted!!!

Can i suggest that you change you home number with BT as that way at least you will get a bit more peace and then DFD will also get annoyed as they cannot contact unless done so in writing and i would also write to them formally requesting the cert as a matter of urgency telling then that you are looking into taking this further.

I really get annoyed at these companies as they are so called supposed to be helping but the seldom do.

    Hi K2nga
I have been trying to get this for months, ive phoned, faxed, recorded delivery letters, emailed. All they do is either ignore you or threaten you with costs , baliffs, etc etc. Thanks to this site i know my rights and they know i know which is why thay are being such B******s.
My court wont do my BR with out this cert so im in catch 22.
Think i might give the court a ring and explain to see if they can do anything.
DFD seem to be a law unto them selves!!!!!
Thanks for the BT suggestion, will do that tonight.

Might be worth contacting the court that you are going to go BR at and ask them whether the certificate will be required.

Have a read through this thread:

Link: Certicicates of non compliance and BR.

EDIT: Missed this bit "My court wont do my BR with out this cert so im in catch 22.". :(

Bit of a long shot here, but if you went ahead with your BR without the certificate presumably the court would suspend your hearing, could the court then demand DFD supply the certificate?

It would be sooooo helpful if all courts played by the same rules!

I wish it worked like that.
They will just suspend your hearing untill YOU have got the cert!!!!!!
Apparently its nothing to do with the court !
They have just told me to get legal advice!!!
How can i afford a solicator when i carnt afford to live!!!!!
It's taken us 3months to save up the money to go BR!!!!!
