    Well - I take people to court all the time, so far Monday and today, and a case in for Friday as well (-:

    Personally, neither for me. OH took his part-time-student-job employer to the Tribunal for constructive dismissal and won.

    This one had me thinking that's a lot of court time then looked at your profile and saw your occupation!!!:rotfl:
    A retired senior partner, in own agency, with 40 years experience in property sales & new build. In latter part of career specialising in commercial - mostly business sales.

    It is nice to see the value of your house going up'' Why ?
    Unless you are planning to sell up and not live anywhere, I can;t see the advantage.
    If you are planning to upsize the new house will cost more.
    If you are planning to downsize your new house will cost more than it should
    If you are trying to buy your first house its almost impossible.

    I took my former housemates to the small claims court when they ran up a £600 phone bill calling their drug dealer and their relatives in Kenya. They didn't contest it, paid half, and then moved with no forwarding address. It was a pretty easy process.
    Hurrah, now I have more thankings than postings, cheers everyone!

    I took my ex partner to court for running off with my friend, leaving me with a rented property. Her solicitor told her i would not win but i was awarded £1600 for the rent and bills.

    Dont forget too, that a lot of house contents insurance (and other services like credit cards etc.) give you freebie legal cover. This isnt automatic, you have to submit all details and then a panel decides whether the case is at least 70% winnable and you get your legal fees paid for - normally having to use their (sometimes very duff) solicitors though.

    I took my former landlord to court for not returning our deposit, and won. I filed through moneyclaim, it was relatively straightforward (a few forms got returned for various reasons) and the court appearance went as well as these things can be expected to. I had legal representation through my employer, which meant that we didn't have to directly speak to LL during the hearing; he represented himself and got all wound up and contradicted himself, which I probably would have done in his position so I'm glad I didn't have to speak for myself! Got back 85% of our deposit, plus fees, he'd wanted to keep 100% of it.

    I've taken debtors and an ex employee to the small claims court. Got judgement every time:T . Didn't always get the money, though:o .

    There are ways of enforcing the judgment. The way we finally got money off a very rich man who was also very dodgey was to apply for an Oral Examination - where he would have to go to court and explain why he hadnt paid and open his books and bank accounts etc. If they dont turn up they can be arrested :) We got our full money sent by his solcitor mate and we claimed interest on top which he also sent.
