I am an EA who has never taken anyone to court but has never really had anyone owe us money. I often read posts where people say they are thinking about taking an EA or even solicitor to court. Or they have been threatened with court action by an EA.
Has anyone any experience they could share as I would be interested not only from my EA side but also as a lay person.

A retired senior partner, in own agency, with 40 years experience in property sales & new build. In latter part of career specialising in commercial - mostly business sales.

DH and I are currently taking the landlord of the first place we rented in Milan to court. Its due to be heard at the end of January. Obviously different law though.
We would have prefered to reach an amicable agreement (and would have accepted a loss to have done so despite legal advice).
The insight into the Italian legal system so far has been ....novel...but we have very kind legal advice and great support from the other officials involved.

Not yet but about to take ex-tenants to small claims. Is this what you mean?. They have until august 15th to make an effort to pay otherwise they will be served the papers0

If it's for a fixed amount (and not huge amounts, usually less than £5000), do it online - all very straightforward

Otherwise, you can get the forms from a local county court (including for non specific amounts), and they are very helpful on what to do and how to do it (but not as to the rights or wrongs of the claim itself - only the judge will do that)

Thanks...we have had a look at the online stuff and it does seem to be the easiest way to go, so that's what we'll be doing.

i have taken a service provider to court and won and i am about to issues my ex solicitor with a summons to the small claims court.
its very informal - very straightforward - you write your evidence "Statement of Truth" and send it to the court - they offer the other lot a chance to defend themselves against your statement - it goes to court - you argue your case, the other lot argue theirs, the judge makes a decision - end of
it is often just in a small office - a few tables and a chairs, no wigs, no gowns, no formality and judges try to put you at your ease,0 -

Well - I take people to court all the time, so far Monday and today, and a case in for Friday as well (-:
Personally, neither for me. OH took his part-time-student-job employer to the Tribunal for constructive dismissal and won....much enquiry having been made concerning a gentleman, who had quitted a company where Johnson was, and no information being obtained; at last Johnson observed, that 'he did not care to speak ill of any man behind his back, but he believed the gentleman was an attorney'.0 -
We were taken to court by an landlord and ended up paying because we couldn't be bothered agruing however when the opportunity arises to look around the property again, ie when it next comes up for rent I fully expect to be calling the police to have him charged with gaining money by deception.0

i got 6 months and the judge did say "send him down" seriously though i have just ended a 9 year legal battle that cost over 1 million in costs...i wonIt is nice to see the value of your house going up'' Why ?
Unless you are planning to sell up and not live anywhere, I can;t see the advantage.
If you are planning to upsize the new house will cost more.
If you are planning to downsize your new house will cost more than it should
If you are trying to buy your first house its almost impossible.0
