Not sure i get the layout of your yard, but could the landlord put a fence up with a gate so that the path can still be accesed? I don't think the clean neighbourhood act will help if its on private property, but i could be wrong. Its probably best to contact local dog warden to get advice on dealing with the situation, but i don't see anything wrong with poop scooping and leaving it on his property.

its a terraced house - We share a path with neighbours. We have a wall at the bottom and a gate but next door doesnt have a fence on their property so the dog just walks straight across. We all said we'd pay for a fence - my LL was even going to put it up but next doors LL said she doesnt want a fence putting up
