Vax cleaners at Argos

i bought one of these 3 months ago and on Sunday it stopped working. I took it back to Argos who refused to replace it but wanted to send it for repair.
on the handle it states 'Do not send back to the shop' now you dont know this until the item has been bought.
What rights do i have over this?

your contract is with Argos, they are entitled to send it for repair (I'm sure there will be a reasonable amount of time it will be away for, you might want to get this in writing from Argos).
I suspect Vax write this on their products so that other people in queues buying Vax's don't see someone bringing a faulty one back, of course I may be wrong.

I would stand outside my local argos, with broken vacuum cleaner and demand the right of free speech.
Just as long as I am not causing an obstruction, I am sure people will listen. then I would raise this with Trading Standards, take argos to court and sue them. Let us teach them a lesson they deserve.0 -

Faulty goods are always the sellers responsibility - he can claim of the manufacturer later if he chooses but he must settle your claim. However if you accepta repair it is reasonable for him to send it back to the manufacturer to get this done.0 -

The manager at argos wont budge on the replacement or refund. I stood and quoted the SoG's act to her and still she wouldnt help. I have contacted head office and even they dont want to know.
Vax will repair it free as its still under guarantee but i want Argos to take responsibility for their goods.
Argos will only replace if its within their 30 day policy.:eek:
the moral of the story is....
1. Dont buy from Argos
2. The SoG's act dont work.

The current consumer rights state that within 30 days you are entitled to replacement, repair or refund (your choice).
After the 30 days it comes down to the warranty held. If, as in this case, it is a back to base repair, they have a right to repair within a resonable timescale. There is a debate on what reasonable is, but normally a 2-3weeks. If they are unable to repair, they have an obligation to replace, if a replacement is not available they must refund.0
