Abusive additional card holder

I think it's quite likely, if OP was actually about to get a CCJ, that GE will have sold the debt by now. Therefore they are correct in saying that OP doesn't have an account any more, as it's been sold to someone else. This should mean the old account with GE is closed so can't be spent on any more. However he should demand confirmation in writing that the account is closed and that nothing more can be spent on it.Don't quite understand how there can be any question of you having an account with them if you have just paid the arrears on it. Doesn't the paper work you received asking for payment contain the account details?0 -
I am not sure that this is the case.
With Credit Cards, there is no such thing of a joint account. The Primary Card Holder is solely liable for any debts accrued even if they were unaware of the activities of the Secondary Card Holder.
I think a civil case against the friend\partner is on very dodgy ground.
You have a civil case over any verbal agreement. The credit card records would support the notion that one party allowed the other to borrow and the second party started to pay it back but didn't pay it back in full. The credit card statements would back up a civil case against the secondary card holder.
Though I suspect you are correct in so far as the primary card holder being liable for the debt to the card issuer, instead of the account being considered "joint".
I look at the small claims court

would clarify how to go about it, but I would suggest the statements show that the secondary card holder has borrowed on the account and only paid part of it back, and this paying part of it back supports the notion of a verbal agreement to pay it back between the 2 parties rather than the situation being a gift from the first to the secondary.I wonder why it is, that young men are always cautioned against bad girls. Anyone can handle a bad girl. It's the good girls men should be warned against.-David Niven0
